i have a 6 yr old son from my first husband, our marriage has been annulled.

my fiance has just filed 129F, we were wondering if we still need to secure parental authority for my son even if his real father is also in US.

HELP PLS!

I myself is annulled and as per the guideline if we are granted sole custody no need for travel permit from the biological father.

Hi - my wife had a 5 yr. old son (he's 7 now) but was never married and we worried about that too. I'm not a lawyer, but I remember someone posting the Philippine Law which states that in the case where the father was never married to the mother of the child, the mother has sole legal custodianship of the child and therefore no permission is needed from the father. I would assume that since your previous marriage was annulled, that means the marriage never took place and therefore you have sole custodian of your child. I would recommend that you consult with family courts in the Philippines to make sure that your former husband doesn't have any legal rights to the child.

When you go to the CFO seminar, they also may be able to answer any questions regarding custody of your child. As for the Consulate at the Embassy - at my wife's interview, she was asked where the father of her child is, but they didn't ask for any documentation. Be sure to have pictures for you interviewing showing you with your child from baby to the age now, to establish your ongoing relationship with the child. :)

I am a single mom with two kids. The kids' father signed the paternal acknowledgement on both my kids BC but I didn't need parental authority from the father of my kids in any part of the visa process nor was ever asked for one.

I just don't know if same rule applies to those who are annuled. If there was no custody battle between you and your ex husband then, being the mother, you automatically have full custody of the child right? There are several vjers who have been annuled and i don't think they were required parental authority from their exes. Parental authority is I think an issue when you will be securing your kids passport and when travel time comes due to the travel clearance that must be secured from DSWD but since you are considered a solo parent, you will not need that travel clearance for your child either.

this is from DSWD website (http://www.dswd.gov.ph/faqdetails.php?id=41):

Q. Who are considered Solo Parent ?

A. Parent left alone with the responsibility of parenthood due to (1) death of spouse, (2) physical and mental incapacity of spouse as certified by public medical practitioner, (3) imprisonment of the spouse for at least one year, (4) legal or de facto separation from spouse for at least one year, (5) annulment of marriage as decreed by a court or church, (6) abandonment of spouse for at least one year, (7) a woman who gives birth a result of rape and crimes against chastity, provided the woman keeps and raises her child, (8) unmarried mother or father who has preferred to keep the child instead of others caring for him/her, (9) any other person who solely provides parental care and support to a child provided he/she is a duly licensed foster parent of DSWD, or duly appointed legal guardian by the court through adoption or legal guardianship, and (10) any family member who assumes the responsibility as head of family as a result of death, abandonment, prolong absence or disappearance of parents/solo parent for at least one year.

TRAVEL CLEARANCE FOR MINORS (http://eservices.dswd.gov.ph/modules/forms...C&showCov=1):

WHO DOES NOT NEED TRAVEL CLEARANCE?

  • A minor traveling to a foreign country with either parent or with his or her solo parent or legal guardian;
  • A minor traveling abroad whose parents are in the Foreign Service or living abroad or are immigrants, provided he/she is holding a valid pass such as a dependents visa/pass/identification card or permanent resident visa/pass/identification card which serves as proof that he/she is living with parents abroad and their travel does not constitute child trafficking.

Yes, both my kids are with me... we received our visa june 3 but we are still in the Philippines coz the kids wants to stay here and spend time with their friends some more plus the fact na mas mura tickets sa september so nag-ok narin ako to stay here a little while. We do have tickets already, we will be leaving on sept 4.

the kids were with me during interview. the prescreener asked for the birth certificates: mine and the kids

the only questions were: are they my kids, how old are they, their names, what do they think about my fiance. tapos the consul asked to see photos of my kids taken with me when they were babies, toddlers. So i showed him several pictures and one montage which i arranged in chronological order. (that is one thing that you should not forget: pictures of you with your son since he was baby.

questions about sa father nila: how long have we been separated, do I or the kids have communication with him, when was the last time they saw their father.

You and your son will be ok :thumbs: just be ready with all the necessary documents.

hi to all. how about in my case. me and my Fiance have a 2 yrs old son but we are married, i read some of the thread here that some went to DNA test? do u think it is really needed, even my his dad sign his BC. im just little worried cuz its money again and 800 ans so is big amount already. does anyone here enlighten me. thanks.

You can also secure a Solo Parents ID from your local Social Welfare Office. It's what I showed to

the Airport guards in lieu of their birth certificates.

if you clicked on the link i gave you earlier it is actually the Benefits and REQUIREMENTS (documents) for obtaining a solo parent's ID and everything else you need to know about it. Here is the link again: http://www.dswd.gov.ph/faqdetails.php?id=41

i have not heard of any k2 visas that had been denied, unless the k1 was also denied. K2 is just a derivative visa. It will only exist in connection with k1, whatever the outcome of the k1 shall also be the result for k2.

i can't speak for the parental authority and full custody issues though coz annulled marriages may have different ruling. my kids are not legitimate since i was never married to their father so i do have legal sole custody of my kids and also full paternal authority over them... and the fact that he has never supported us financially all the 8years that we have been separated, he had also surrendered any right he may hve left over MY kids.

i do hope you will get all the answers you need soon. i could understand where you are coming from because i am also a mother and through this entire process, my worries had always been over my kids, ganon siguro talaga ang nanay. (F)

Hello :star:

Yes, my marriage was annulled and I was given custody of the children.

The documents that the City Social Services and Dev't Office (CSSDO) asked from me:

* Photocopies of the Certified True Copy of my Finality and Annotated Marriage Contract

(I showed them the original copies)

* Photocopies of my children's BC

* Barangay Clearance for CSSDO purpose

* ITR

* 1x1 picture for the ID

I haven't read yet cases of K2 being denied. Maybe other forum members can shed light on this as well as on full parental authority.
