(it helps to imagine reading this on a crumpled cardboard sign at a busy intersection)

Please Help! Hard-working, kind-hearted American man, dupped by conniving woman.

Her visa expired, my money too! Anything helps, God bless.

Even with the benefit of my exceptional stupidity and gullability, my lawfully wedded dependent can't muster the slightest sympathy play to compell me to fund her immigration so I can pay for the divorce and support her while she finds another man.

Can the USCIS help? If I explain the situation, would they at least send her a letter telling her to spend my last few dollars on a plane ticket home? The leaky boat can't last much longer.

Depending on the visa category (you don't mention whether K1 or K3) "expiration" is meaningless. For K1, the visa is dead on arrival. Status is derived from the I-94. I take it her status is "pending adjustment".

If so, you may simply withdraw your I-864 and she won't get a green card. How you deal with her financially then becomes no longer an immigration matter but a civil one.

Depending on your evidence, it's possible you can get her deported too but that's a separate issue as well.

Can you really withdraw your I-864, not that I want to, but others here said you cannot. As far as getting taken or screwed, seems like the entire world is that way, whether it be a vacuum cleaner, some kind of pill, an insurance policy, used car, you name it and particularly with women. They far outnumber us in the middle age class and if you own a nice home and have a couple of bucks, you really are a target. Dated off and on, already was divorced for eight years before I met my wife and some of these gals really came on strong, way too strong to suit my tastes, just said goodbye, yes I was cussed. Ha, certainly met my share of young stuff that claimed to be looking for a mature settled man, ha, said I was looking for a wife and not another daughter. When I was pretty sure about my wife, introduced her to my entire family, and I met with hers as well, was really all set to marry her after a year, but the USCIS gave us another. Just commented to my wife, if we are still together after all this, we are really meant for one another.

Sure enough sad stories on the internet from guys that were trapped, you did not do your homework and didn't observe the tale-tail signs, like you, there are others on this board that want revenge. Can only say that no one twisted your arm to get married, and maybe she played on your ego, it's your own damned fault. You can give your side of the story to the USCIS and see what happens, but it will be just that, your side of the story.

We also heard just the opposite, where the woman comes here to marry a jerk and a salve driver, but if there is one common factor, all these marriages were rushed into. I talked this over with my wife, certainly a very rare subject with us, but if anything happens to us where we want to split, I can only thank her for the most happiest six years of my life, she said the same. Feel it's a true miracle of God to meet the right person. After that long extra one year wait, we still can't believe that we are together.

In this case, yes because the AOS is not complete. After the immigrant has a green card, the answer would be different.

Revenge? I don't do revenge. I've bent over backwards to help this woman. Even offered to get her immigration and start a new life if she would just get off her lazy butt and help a little around the house. I've been far too kind. Fool me 80 times, shame on me, fool me once more,.... not going to happen. (the 81st was 7 months ago)

I wish her all the best and a happy life with a rich husband, but she needs to leave my house.

Yes, she came as a K3. Did I mention she has a history of domestic violence here? I'll send the letter to the USCIS and see what happens.

Thanks,

Brian
