Timeline

HI, I recently submitted a I-130 for my wife, she is a japanese citizen and we have been married for 6 years. I recieved the I-797C but the priority date was empty. I have not yet recieved any other information , request, or contact from the USCIS. I am woundering is this normal and I just have to wait longer? The recieved date is June 1, 2008. Thanks for your time.

A visa deemed to be immediately available for the spouse of a US citizen, therefore there is no priority date. This is normal.

A visa deemed to be immediately available for the spouse of a US citizen, therefore there is no priority date. This is normal.

So... Because he and she has been married for a few years, as soon as there I-130 passes, she gets a visa?? As where a person who filed a I-129f has a priority date on there I-179c (NOA) and will have to wait longer??

So... Because he and she has been married for a few years, as soon as there I-130 passes, she gets a visa?? As where a person who filed a I-129f has a priority date on there I-179c (NOA) and will have to wait longer??

I believe ALL I-130s for spouses are deemed "immediately available" as opposed to waiting for a lottery number as may be the case with some other I-130s.

The reality is, "immediately available" is a very loose term. What it means is, "immediately available...as soon as we get through the with all the other immediate requests".

The fact that the OP was married 6 years, will have an effect in other processing in that they are beyond the 2 year probationary marriage period (note...probationary marriage period is my wording, not official terms). I'm still kind of new to all of this, but recall the 2 year period having an effect downstream.

To the OP, your 797 is known as an NOA (notice of action). Things to do now....

1. Enter your timeline on this site...it helps you and everyone else.

2. Go to the USCIS website, register for e-mail updates. Your receipt number is your case number (leave out the dashes)

3. As was said earlier, all looks normal...nothing to worry about.

4. Keep all your fingers and toes crossed that the long waiting periods are over.

Timeline

Immediate means that they will give you the next available appointment at the embassy without having to wait for a visa number. Even if you have to wait a few months, it's nothing compared to 5-10 years that people in other visa categories have to wait since they're actually waiting for a visa #. Once they get a visa #, they still have to wait for an available slot at the embassy depending on how busy the embassy is.
