I recv a rfe for the K3 , I would like to know if I send them a copy of the document they are requesting, or should i be on the safe side and send them the original if i have two originals. It does not specify whether o send a copy it just says to send them the document. Im still wondering y they are requesting this because i already sent the document in when i completed the I130, I will give them what they need. This is the uscis but i wonder if the one i sent was not good enough ....

If you have two originals, I would send one of the originals. Usually it specifies whether you can send a copy or not. If you're not sure, why risk it? If you send a copy and they ask for the original, it will only dely the process even more. What is the additional evidence they are asking for? That will help determine if you should send original or not.

They want my final divorce decree, which I in fact gave them when I filed I130

A copy is fine but my best guess is you sent an unacceptable document, so sending another copy of same will not help you. A final divorce decree needs to bear a stamp from the issuing authority, the judge's signature and the vital statistics for the two parties. Generally, you would request a "certified copy" of the divorce decree and send a photocopy of it.

Just what did you send the first time?

Ok, this I know about.....I had to give them mine also. I sent them a copy because that was all I had at the time. It was only when I tried to get married that they actually asked for the original. I was shocked. I thought, If the USCIS and the US Embassy in Lagos, Nigeria would accept a copy....why won't you?? lol. Well, I had to eventually send for it from another state. But as far as sending it to USCIS, copy is fine.

Ok, thanks so much but the one i have says a true copy and it has the judge name stamped on it but there is no certified that she gave me at that time. It also has all our information on the fron page and the court dsitrict where it came from etc, but its a true copy i called rfe line but officer said copy was fine . i'm confused i will just get a certified one to be safe .

You need a jurisdictional stamp, not just a rubber stamp signature of a judge. Get a "certified copy" and then mail a photocopy of it in response to the RFE.

A photocopy is always fine to submit with a petition but it has to be a photocopy of the right document. Yours wasn't.
