I found this forum a week or so after I mailed in my I-130. I did not include any of the recomended evidence of a bona-fide marraige. Am I going to get a RFE? Also, since we live in seperate countries, and don't have any kids, the only evidence on the list I could produce would be sworn affidavits. Should I start assembling them?

I didn't send any either. The marriage certificate is evidence of the marriage. That evidence is more for people adjusting status, who have lived together long enough to have proof. That is my take anyway.

CR-1/IR-1 Journey for Self

12th April 08 - Married in Australia

21st April 08 - Mailed off I-130 but with incorrect title on cheques

30th April 08 - USCIS returned petitions requesting correct title on cheques

2nd May 08 - Mailed out I-130s again! Finally on our way!!!

9th May 08 - NOA-1

7th Nov 08 - Tranferred to CSC

4th Dec 08 - Approved!!!

22nd Dec 08 - NVC # assigned

23rd June 09 - Case Complete at NVC (We slowed down the process on purpose to time interview accordingly)

18th August 09 - Medical

25th August 09 - Interview Date - Approved!!!

19th February 10 - POE L.A (No dramas, just SLOW)

2nd March 10 - Welcome to America Letter

With I-130 you need to send a copy of marriage certificate and a copy of naturalization and also a copy of birth certificates.. and also G-325A for husband and wife... What you mean by "recomended evidence"

They're referring to the following found on page 2 of the I-130 instructions:

In addition to the required documentation listed above, you should submit one or more of the following types of documentation that may evidence that bona fides of your marriage:

E. Documentation showing joint ownership or property; or

F. A lease showing joint tenancy of a common residence; or

G. Documentation showing co-mingling of financial resources; or

H. Birth certificate(s) of child(ren) born to you, the petitioner, and your spouse together; or

I. Affidavits sworn to or affirmed by third parties having personal knowledge of the bona fides of the marital relationship. (Each affidavit must contain the full name and address, date and place of birth of the person making the affidavit, his or her relationship to the petitioner of beneficiary, if any, and complete information and details explaining how the person acquired his or her knowledge of your marriage); or

J. Any other relevant documentation to establish that there is an ongoing marital union.

Since we'd already been living apart for 6 months when we filed, the only thing we submitted with ours were phone records. We downloaded my husband's cell phone bills to excel spreadsheets and edited out all irrelevant calls (the bills are over 40 pages long as the cell is also used to run a business). We also included a letter explaining how the records were edited and why, and that copies of the original bills in their entirety will be presented at the interview. Not the most conclusive of evidence, but 4 months and a touch later, still no RFE.

USCIS has not been strict on providing evidence as that is asked for when then couples haven't been married a long time and reside in different countries.

Start gathering it for the interview tho as it WILL come into play at that time. Establish joint accounts, life insurance, wills. money transfer records etc.

Making another trip counts BIGTIME! Pictures of such also.

Phone and communications records [Phone cards don't count much unless the phone numbers show].

Getting the initial submission approved is usually easy.

The embassy interview is another story!!!

Relax, we didn't submit any of those evidences recommended too (though we have been married for 3 years!)

We received RFE for a marriage certificate in foreign language that omitted. They didn't ask for further evidences for bona fide of marriage.

OK, so sa backlogged as they are, they're probably not that strict with evidence, it seems?

I've been living in Thailand with my USC husband for the past few months. We plan to stay here a year more, not sure yet when to file the CR-1 or DCF whichever we qualify for. Do you think we should live togther longer, get pictures of us and affidavits, and also a joint bank account as proof? If we submitted just the marriage certificate (translated), affidavits and photos would that be enough? I'm not sure if joint-tenantship would be allowed since the hotel/aparmtent says only one person is needed on the contract.

By the way, are birth certificates of both parties necessary? I thought only a photocoy of the USC passport is needed?
