Hiya people, I have read the guides and all the information regarding a expidite request. I am wondering if our case would have a chance of one. As some of you may know in another post of mine, I am in litigation with workers comp. I am unable to return back to my previous kind of work. With the labor market like it is and my job related skills, (I installed heating and cooling system in commercial and residental buildings), from the time I got our of the Army this is all I have done. Before my accident I was making just over $40,000 a year. But now I am having to look for work with no pratical skills in a job market that really sucks. Once the litigation is done I will have enough money to live on for 2 years plus go to school to get a better job. Right now I am finding it real hard to support 2 household.

Now the details: my wife lives with her family in the Phillipines but she does have bills and contributes to the house hold. She is pregant and was advised by her OBGYN to not work as she is in the higher risk of pregancy group due to past family history, so I send her money to pay for her bills,food and share of the bills. I am currently staying with my dad taking care of him after my mom passed away last year. I have my own bills, car payment,insurance and such. My income is down to hardly anything and things are going to start getting scary. My dad is going to help me out and I will pay him back once i settle but I dont feel good about that.

Based on all this information, would I have a chance at a expidite or am I just experiencing wishful thinking? Thanks for taking the time to read and answer.

Wishful thinking, IMO. At best, you've stated a reason to deny the visa based on public charge concerns.

Facts are cheap...knowing how to use them is precious...

Well, once the lawsuit goes through I'll have around $100,000 in the bank so I really doubt that will happen.

Oh well I figured it was wishful thinking.

Wishful thinking, IMO. At best, you've stated a reason to deny the visa based on public charge concerns.

I second what Pushbrk says, and would like to add this: First, without the expedite parole it is going to take longer, so take a breath and accept that. The good thing is that the consulate in the phils processes things faster than Guangzhou, China. Second, you will need to have you dad or someone with more money to co-sponsor your wife. That will overcome the public charge issue that PB brought up. Read the guides, be patient, and things will work out.

Even though you expect a lump-sum workers' comp settlement, I suspect USCIS will not see that as evidence that you can support your wife over the long haul. After all, $100,000 earns only $2-5 thousand a year in interest unless it's spent down, and then it would disappear in 3-5 years. If your father has continuing income, he would make a good co-sponsor, I think.

Well my father is going to be my co-sponsor. He has between 50,000 to 60,000 a year in income. I figured everyone had already read my past thread about that. I should of stated that fact in this thread.

Even though you expect a lump-sum workers' comp settlement, I suspect USCIS will not see that as evidence that you can support your wife over the long haul. After all, $100,000 earns only $2-5 thousand a year in interest unless it's spent down, and then it would disappear in 3-5 years. If your father has continuing income, he would make a good co-sponsor, I think.

A potential future lump sum is of no consequence but three times the 125% guideline in liquid assets will meet the minimums. For two people, that's just a little more than $50,000. 3-1 is the standard, not expected interest on principal.

Co-sponsor or no, the problem here is the "emergency" is that the foreign spouse can't work so they want her here, where she can become a public charge for purposes of the medical expenses etc. (Not saying that's the motivation, just that it would be the legitimate concern.) Once she's in the USA, there's nothing to stop them from showing up at the door of a hospital with no insurance.

My wife and I are looking forward to adding to our family, hopefully a little girl. but there is no way in hell I would let her go through a pregnancy by her self... especially a high risk pregnancy !! I am thinking that the USCIS will surely think she and the baby will become a public charge. Do you have medical insurance for your wife and unborn child. or a plan for it immediately when she enters the states. Is this your first child?

I agree with you on that. It is accually very cheap to have a baby in the Philippines, less then $2000 usd. I am not concerned with the cost of of having a baby here in the states, I paid for 3 births that put me back more money then I care to remember. You are correct, its not my motivation to become a charge of the state. I have never been on public assistance and never will. The whole reason that i would request a expidite would be the finacial reasons I stated. I knew it was a pipe dream. Thank you again PK.
