Questions of EAD and AOS...

Timeline

I have yet another general question... I HAVE read the guides and they just confuse me, so I'm hoping for a straight answer if you guys know it :)

I am getting a bit ahead of myself but I would like to know if it is possible for my fiance (coming from mexico) to start working as soon as he gets here. If he can, what are the circumstances and if not, why not? i'm confused on the whole EAD process and AOS... he comes to US; applies for EAD AND AOS? We would LOVE it if he could start to work after about a week or 2. We even have a job lined up for him for his return, but I'm afraid he won't be allowed to "legally."

How can we go about doing this? Another questions is.... when does he get a SSN? And when is he "officially" a Resident of US?

I hope I'm not being repetative, but please let me know your knowledge :) Thank you SOOO much!

9/04/2008 Jorge Received the packet I sent him for the interview. YAY

9/05/2008 Jorge Received his packet 3 (identical to the one I received)

9/07/2008 Jorge flies to Juarez for Med and Interview

9/08/2008 Medical Date- went well :) He stood in line since 5:30 Am. He finished at 11:15 AM - ish

9/09/2008 Interview- SUCCESS!

9/16/2008 POE

9/17/1008 Arrives to East Wenatchee, WA

9/27/2008 Marriage

AOS EAD Steps

11/07/2008 - And so it begins

Hi Maria,

How are things going? I haven't studied all you're asking, but I have read that if he enters the USA at the New York Airport JFK, they give him a work permit that's good for the 90 days of the K1 visa. But in that 90 days you marry (as soon as possible) then file for the AOS, EAD, and AP travel document all at the same time. You don't have to pay extra for the EAD or AP if you send with your AOS application. I think the AOS takes longer because of FBI backgound check backlogs, but the EAD and AP can come in 2-3 months. I know JFK is way the wrong direction from you, but that's the only place doing the work permit thing. I guess he could book to JFK, then another cross country flight to get home to you. That might cost a bunch of money and waiting the couple of months might not look so bad. Guess you will have to check it out since he does have a job lined up. For people with no job prospects, they could be searching for a job for 2 months. So in your case, it could be worth it.

SSN: They say to wait at least 10 days for his name to get in the system from entering the US. Then you go to your closest Social Security office and apply. I've read various reports on local offices being easy and others not quite understanding the rules and it all gets confusing. I'm sure somebody who knows this well will chime in. I just wanted to say hi mostly. Looks like CSC is already approving some March people. That's super. :thumbs:
