i just recieved an email from the Department of State 4 months after the embassy told us that our case was going into Administrative Review. What are they looking for and is this normal? I mean do people normally just pass through this or is this something I should be very worried about. I don't want to sit around waiting anymore if they are just going to tell us in a couple months that we have to start over or something. Help!

Hi Wrestgirl,

There are a lot of women here who have gone thru administrative review/processing. I'm sure one will be along shortly to give you their take on it. If you could share what the email said/asks for - maybe that will give everyone a better idea of where you are/if it's a bad thing, etc.

I'm anticipating being in AR/AP eventually too...my heart goes out to you!

I am sorry that you are going through this waiting. I understand how difficult it is and I believe there are others like you that have to wait through this kind of review. I can't relate because my husband is coming as a refugee so we just keep getting told that his background checks are complete and there is no one to call. If you could mention what the letter says exactly I am sure other members would be able to help you more.

AP is typical for this region and can last from a few weeks to several years. They are preforming background checks, and name checks, and this is done through several agencies. Look at the time lines for your country to research the average wait from this point.

Did your husband get a 221g with any information on it? I may be wrong and i hope I am, but it looks to me like your file was returned. Otherwise why is USCIS reviewing it?? Doesn't the file remain at the consulate while the names checks are done?

so here is the story. I hope it helps so I can get some more advice:

When my fiance and I filed we were at 2 year 3 months from seeing each other. With him being from Iraq, he was not able to leave Baghdad for over a year due to curfews and he was injured in an explosion the second year. Obviously I was not able to go see him. USCIS approved our hardship and the papers went to the Syrian embassy. After 2 interviews and us providing more and more hardship evidence, they still did not like the fact that we had not seen each other is soooo long. It was also my understanding that everything says we should not travel to see each other after filing too. So they sent our stuff back to USCIS for a review. I called yesterday and yes, that is what has happened.

So my question is...what is best. We have about 3 months before it will truely get looked at since they just recieved it. SHould I go out and see him, then send to USCIS updates on our proof of relationship? Then also get my senator involved? And if it is denied in the mean time send in the stuff as an appeal? Or should we just get married and refile? What is the shortest and best way to go about this? Has anyone gone through a review like this?

God, that sucks. Maybe you should talk to a lawyer.

it comes back to calif and they let it expire, i got my rep involved and they got a return email from calif explaining it was to expire and we would be free to refile after paying the fees, they will send u nothing i have yet to hear from calif on ours fr that 07 return date, i only heard thru my congresswoman. We chose to marry and refile cr1

Don't get marry and refile without receiving a decision from USCIS like NOD or letter for sure that its expired as it might trigger an entry ban on him. I think such topic is pinned in MENA

I believe that they have changed their process and are no longer notifying people on the K1 like they used to. Brnid is the unfortunate expert here. Wresgirl, Wow how quirkey is that? You can't go there because of the war and he obviously can't come here...how are you supposed to see him?? Make sure you check things out for your own knowledge but sounds like trying to see him and refiling is the way to go.
