Help! I was holding this off for a while now; and thought this would sort out soon. Well, this is what had happened...my fiancee had the interview on March 12th of this year and was told to come back and pick the visa up in 2 days. The following day, she got a phone call from the embassy saying that the case is under administrative process and they will let her know the decision when completed. #######!!! So I email them and was told the same thing that the case in under admin process and will be notified when completed. I would email them at least every 3 weeks and still got the same answer... so I wrote a letter to my congress to check the status and help if all possible. They got the same reply as well. Now I am very angry and thinking of going the next step higher but I don't know where to begin. Anybody got any advice(s). Thanks

Dear Thai Style,

I am so sorry to hear of your situation. The following link suggests that one option is to call the DOS's office of visa services. I called them once on another matter and got a very helpful person on the other end of the line, not that it is always the case, but it's at least worth a try. The hold time is fairly long, but a least you get to speak to someone. Their fax is .

Hoping you can be together soon! My DIL's interview is this week. Any suggestions?

II. ADMINISTRATIVE REVIEW

Administrative Review" refers to a Consular Official placing the case "on hold" because the Visa Petitioner or Beneficiary FAILED TO PASS the security name check or background check, or because the Consulate or State Department or Homeland Security NEEDS TO INVESTIGATE some issue or matter in the case more closely. Cases placed into Administrative Review can ADD WEEKS OR EVEN MONTHS to processing time and final decision on visa issuance, typically in most cases AT LEAST 4 to 8 weeks additional time. Under current regulation, there is no right of appeal within State Department or Homeland Security for administrative review status. It is suggested that visa petitioners and beneficiaries keep track of the status of their case as best as possible, and secure, if possible, the reason or reasons their case has been placed into administrative review, which at least helps to relieve some anxiety during the waiting time.

STATUS CHECK OF CASES IN ADMINISTRATIVE REVIEW: Status Checks of cases in administrative review should first be addressed to the Consulate in question. Click Here for List of Consulates. The State Department's Office of Visa Services can also assist in status checking of cases which are unusually delayed. Tel: (Punch 1, Then 0, Avg. Wait Time Approx. 15 minutes to Speak with a Live "Visa Specialist", ET 8:30 AM to 5:00PM). E-Mail: usvisa@state.gov Click Here for More Information. For people who want to be active during the painful waiting period, especially if it becomes protracted, here are two suggestions: 1. Request in Writing Information from Immigration Service and the State Department under the Freedom of Information Act (FOIA) regarding the reason for the Administrative Delay. See: USCIS Freedom of Information Act Request. and State Department Freedom of Information Request. 2. Order the Visa Applicant's FBI record directly from the FBI and have it ready in case the Embassy requests same. See: FBI Criminal History Record.

Sorry. The fax number for the visas services office is 202-663-3899

Thanks Thai Family for the info. I will look into it and do more research. If they are doing a background check on me, they should double check the package again. I had included my military info as well just to show them that I am a naturalized US citizen and must be a US citizen to be able to retire and collecting pension as I do now. Even my current job now is a Federal employee. I still work for the Fed. (same job, same place, just as a civilian counter part. I don't know what else they would need from my side of background. They have access to everything they need as a military member.

Thanks again; and I will wait for the outcome.

Sometimes it's hard to know how much information to give them. It is too bad there is no veteran's preference in this process. More than one person has asked if being a vet would help my son get his wife here faster. Dream on!

Hang in there. I hope you get some good news very soon.

Just a reminder that AP is usually reserved for background checks done on the beneficiary. While of course the documents state it could be the petitioner or beneficiary, I'd suggest that in this case it might be the beneficiary that is having the name checks done, not yourself.

Hope you hear some good news soon!

Yes it is very good to know that my girl got through the interview. I just don't understand about the waiting. It has been since March 12th for the interview and it has been since April 15, 2007 since I saw her. We are both not getting any younger either; we want to get married and start our family now.
