Right before we made the application for Adjustment of Status, my wife lost all of her documents, including her passport with a visa stamp and the I-94 that was stapled to it. We received a request for evidence because this information was missing from the application (we have no copy of it). We have done a request for a replacement I-94, and she has gotten a renewal passport from her country's consulate (Brazilian).

We have done a police report reporting the loss, and of course have a marriage certificate.

We want to go from South Carolina to California on a plane. Would TSA have a problem with a passport (new) with no visa stamp? We could provide documentation that document the loss to prove she is not illegal. We are not traveling internationally, just domestic.

I saw TSA give a Brazilian a problem here when he was taking a flight to Washington DC and then onward to Brazil because he was not legal, but had a valid passport.

So, summing up, if we bring the documents explaining the loss and showing that her case is in progress, we shouldn't have a problem?

Traveling domestically, she wont need to show her visa. Just identification as to who she is.

Her visa has been used anyway and it looks like you may already be passed the 90 day authorized stay of the visa. If it makes you feel better, take a copy of the NOA for AOS.

Does she have a state ID or DL? She can use that since she's not travelling internationally...
