I'm ahead of myself here, as it's no where near time for me to send the I-134 to my fiance, but I have a question i've not been able to find an answer to on the forums yet.

My question concerns the W-2 forms we must submit. I have not worked in many years as I was a SAHM. My exhusband was the only one working and all my past w-2's are based on his income not mine. For 2007, I do have my own w-2, as I filed on my own as I sold a home and had to pay taxes. In previous years, we filed together as we were married, but the income was his and has nothing to do with if I can support my fiance or not.

I have a co-sponsor, so i'm not worried about meeting those requirements. Here is my question:

I will send a copy of my 2007 taxes as I filed alone, but what about for 2006/2005? I flied jointly with my exhusband, but the money earned was his income not mine. Would I still send a copy of 2006/2005 as well even if the income wasnt made by me?

Also, if I don't send a copy of 06/05 should I explain that the income earned was my exhusband not mine?

10/19/09 - Rec'd NOA

11/05/09 - Transferred to C.S.C.

11/10/09 - Biometrics - Cancelled waiting for new appt.

12/21/09 - Biometrics - Went well with no problems.

12/31/09 - EAD Card received.

02/16/10 - Transferred to Lee's Sumit, Mo

03/04/10 - Recieved AOS Interview letter.

04/07/10 - A.O.S. Interview - Approved. Very easy interview.

04-26-10 - 2Yr. Green card Received.

Every Consulate is different so you should contact Cairo to see if they have any special requests.

Even though you filed jointly it is still considered your tax return and you should send it in. You should send an additional letter explaining why you do not have one(s) for the other years asked for.

My returns were filed with my ex husband as well. The Consulate in NZ only asks for the most recent and stated that having my ex husband on it as well was fine.

Tax returns are actually not required with an I-134 unless you're self employed. Sending three is simply a suggested "best practice". IMO, your circumstances indicate sending just one tax return (and current pay stubs if working presently) in support of your I-134 and full supporting documentation for any co-sponsor.
