Hi. Just some questions about the CR1/IR1 process. I'm living in Thailand with my American husband. We have been here for less than a year, so we have to mail our application to the US instead of doing a DCF. A lady gave us the I-130 package but some things still aren't clear.

1. Is the birth certificate necessary, or would a photocopy of my husband's passport do (to establish ctiizenship)?

2. If a birth certificate is needed, would a photocopy do or must it be an original certificate?

3. Is it only the ID page of the passport that should be scanned?

4. We will be staying in Thailand for the entirety of the visa process. Will this cause complications so far as sending and receiving mails is concerned? (We can provide a US address with no problem. His relatives live there and it's also where he used to live at one time.)

5. Is there any form like the affidavit of Support, etc. that must be sent from within the US?

6. As of the latest, do we need to send originals prior to the interview, or do we need to save those for the interview? I'm confused because there's a notice in the package that copies would do.

1. Birth certificate not necessary to prove U.S citizenship but be sure to photocopy ALL passport pages

2.Yes, photocopy is sufficient.

3. No, all pages - yes, even the blank ones.

4. I would use U.S address so time isn't wasted in posting of documents. A lot of people do this.

5. I am assuming that although the Affidavit of support form can be downloaded and printed from anywhere, I would think the U.S citizen must show income from within the U.S

6. No, do not send originals - copies fine.

21st April 08 - Mailed off I-130 but with incorrect title on cheques

30th April 08 - USCIS returned petitions requesting correct title on cheques

2nd May 08 - Mailed out I-130s again! Finally on our way!!!

23rd June 09 - Case Complete at NVC (We slowed down the process on purpose to time interview accordingly)

If you and your husband have been in TL for 6 months why not do a DCF? That is very fast.

Got to love the fact my wife was preggy and even with a RFE @ NVC she was still here in under 5 months!

Are you sure you don't qualify for DCF? Are you Thai or foreign national who lives in Thailand?

The residency requirement for Thailand is 6 months according to the Bangkok consulate's website:

If the petitioner resides in the United States, the processing time varies depending on the service center where the petition is pending. In a limited number of cases, if the petitioner can demonstrate current residence in Thailand for at least six months, the petition may be filed with the DHS office in Bangkok. The general inquiry email box for DHS Bangkok is BKKCIS.Inquiries@dhs.gov.

Thank you all so much! Actually we already went to the US embassy. They directed us across the street to Dept of Homeland Security. The lady there told us we could do DCF only if we'd been here for a year or had a work permit. I thought it'd be 6 months too, but that's not what she said.

The six months residency requirement is for the USC who married a Thai. But since you are Filipina, may be they have different requirement?

Not all consulates accept USC petitions for a non citizen spouse who lives in that country. Maybe first you have to find out that.
