Hi!! My friend is a legal permanent resident since 2005... She removed her residency conditions filing I751 and got approved a few months ago (I would say 2 months ago) I don’t know if you remember but her marriage is hell.... her husband is verbal abusing her, he is a drug addict ad alcoholic.... (she even has proof if this condition.... jail time that he spend and Worker comp denied same coverage because he did not pass the drug test) well.... to make it short if she gets divorce now, and in 2010 she applies for citizenship (5 years resident) could immigration question her why she divorced so quickly after I751 approval?? She does not want to have problems but she can not hold his marriage anymore... will USCIS ask her for evidence??? Even if she is claiming citizenship through residency and not marriage?

please let me know because she needs same help!

01/31/2008 Transfer to Vermont Service Center (after almost 8 months!)

02/22/2008 This case is now pending at the office to which it was transferred.

02/26/2008 This case is now pending at the office to which it was transferred. (Last Touched)

07/01/2008 : still waiting for a miracle after 390 days of suffering....

07/02/2008: Infopass Appointment. passport Stamp....

07/03/2008: Incredible!!!! Card Production Ordered!!!!!!

07/04/2008: Touched. Duplicate email Card Production Order

07/07/2008: Touched

07/08/2008: Touched. Email with notice of approval

07/09/2008: Touched again!

Hi Ailin, here's the deal...your friend can apply 90 days from the anniversary of her original GC issuance date. Even if she gets a divorce, there really should be no problems for her...I would just have her bring her info from her marriage that demonstrates that she entered into it validly. Marriages break up all the time...her situation would truly matter if she had applied for citizenship based on marriage and then gotten a divorce, which would cause USCIS to deny the application. She'll be just fine.

I told her this.... but you know she is scare... she is even scare of leaving her husband.. or maybe because she still has feeling about him.... I have no clue!!!! but I told her I will find out.... in one post last week someone told me that they will question why she got the divorce so quickly.... and I do not want to be responsible of any problems she may have,,, but also I don’t want to see her suffering like she is now.... this guy is discussing he doe snot work since February just because he does not feel like it!

If she already removed conditions, she just needs to wait for a bit more. Spouses are eligible for citizenship after 3 years of becoming permanent residents.

Tell her to stay safe.

Yeah, but I'd almost rather her get out of a bad relationship and hang out for two years and then apply for citizenship.

Oh no! Tha'ts not what I meant friend!!! Not at all.

If she has removed conditions on her residency already she can apply almost right away. Since you say she became a LPR in 2005; seems to me she can apply already. Also, if she has means to support herself, she might want to think about moving along. A dangerous relationship is NOT GOOD.

She'll be in my prayers.

Feel she is in pretty good shape if she has her ten year green card, advantages of US citizenship, like getting to vote, a US passport, SS disability benefits, and maybe even job with the USCIS may not be necessary to her. My wife was in pretty good shape after the battle to get her ten year card, we did get her foreign passport renewed thinking we had to for that I-551, not planning on getting a job with the USCIS, and listens way too much to the news about the corruption with the electoral system, so figures her vote, or yours, won't count anyway. Our major motivation for applying for US citizen is it was a way to end our six year relationship with the USCIS. Oh, and she doesn't have to carry that green card when she goes to the bathroom, nor tell them whenever we decide to move.

They sure made a big deal about it yesterday as to whether she was still married to me in 2008, but that is a penalty for the three year marriage privilege. Shouldn't have to go through that with the five year. See on the N-400 form, either you are single, married, divorced, widowed, or annulled or some other thing, wonder what that can be? Dependent on which box you check depends on what type of proof you have to send, common proof is that you have lived here and didn't leave the country longer than specified times.

Feel the best advice is for your friend to contact an immigration attorney, all cases are different, being married to an abusive person is never fun, both my wife and my ex's were abusive, but thanks to our wonderful no-fault divorces in both my state and her country, bastards still got halve of everything. But as a happily married couple, we are building up our assets extremely fast and great to have a peaceful home. Can only advise your friend to get out of that marriage and get a new life, immigration is a secondary matter. But have her be a little more particular this time, don't rush, give it a couple of years before tying the knot.

I think she will be fine with divorce.

Even for I-751, USCIS allows exception if the marriage was ended with domestic violence by citizen or permanent resident spouse.

Since she already got 10 year green card, it shouldn't matter whether shy stays with current spouse or not.

If she decided to go with divorce, it will take two more years to get citizenship.

Since she has evidence that her spouse is not capable to manage the marriage, and she already got I-751 condition removed,

she should be o.k. from immigration viewpoint.

I think she should be more worried about how to survive by herself after mass of divoirce and destoyed relationship.

I'm not exactly same situation as her, but I also got divorced after 2 years and half years from green card initial issurance date.

So I'm filing for N400 this time, but I don't expect to get any difficulty from divorce.

I just have to add "divorce decree" to the document list. That's all.
