RESPONSE FROM THE EMBASSY IN GUYANA.........

Please be informed that office will return this petition to the Bureau of Citizenship and Immigration Services (CIS) of the Department of Homeland Security (DHS) for review and possible revocation.

If CIS determines that the information we are providing constitutes sufficient foundation for initiating revocation proceedings, the petitioner will be sent a notice of intent to revoke, that includes a statement of the facts and evidence, and will have the opportunity to respond.

The return process has begun and the beneficiary will be notified in writing once the petition is dispatched to the United States.

01-09-09 - VSC received I-130 application

01-14-09 - Date of NOA1

01-20-09 - Received NOA1 for I-130

06-17-09 - I-130 Approval

09-28-10 - Recieved Letter from USCIS Stating reasons for revocation

10-01-10 - Returned Package to USCIS will further evidence disputing the reasons the Embassy gave for revocation

11-17-10 - DS 230 and Immigrant Information Sheet returned to the Embassy

12-15-10 - Appointment Letter mailed out setting the interview Date for Feb 7th 2011

02-07-11 - 3rd Interview with the Embassy after USCIS reaffirmed the case

02-09-11 - Visa issued

02-11-11 - Traveled back to the USA - and our journey is finally over! A total of 3.5 years!

I am sooo sorry to hear that. From my experience I believe you will be able to get a faster reply and answers and maybe more assistance if you were in Guyana if you are not there right now.

But, that is just speaking from my experience, I do not know for sure. But, that is how I was able to overcome my situation more aggressively because I was at my fiance's foreign country.

And did they tell you the reason for the denial? I am so sorry for your tradegy.

09/2007 - Gathered all documents for I-129F petition.

11/09/2007 - Sent I-129F

11/21/2007 - Package sent back to me( I forgot to sign one of my G-325A forms) I cried my eyes out but sent it next day delivery back to USCIS.

11/27/2007 - Received NOA1

02/13/2008 - Received NOA2

02/20/2008 - Package left NVC

02/22/2008 - Case uploaded into Ghana consulate data system

04/08/2008 - Packet 3 & 4 sent to fiance

04/16/2008 - Packet 3 & 4 received by fiance

06/24/2008 - Interview date (God blessings on this day)

06/24/2008 - DENIED visa at interview

06/25/2008 - APPROVED visa at 2nd interview with senior consulate

06/27/2008 - Picked up VISA

07/03/2008 - Fiance entered USA at JFK POE & Got EAD Stamp in passport

07/18/2008 - Married

08/07/2008 - Mailed AOS application

I'm going to move this to the Embassy forum so you get some more help but I can tell you that your very first priority now is to keep that petition in Guyana! It's much harder to deal with once it's back on us soil.

Put your fightin face on.... hire a good immigration lawyer if you can... and try like heck to keep your paperwork there! Call the Consulate every day if you have to ... go there. Ask to speak to those in charge and beg to have it over-turned or at least looked at again.

Muesh/Suz, I'm very sorry for what has happened to you. I know ever case is unique but having gone through this nightmare I will give a couple pieces of advice:

1. Call your US Congressman/Senator's office immediately and request their help. Your objective in this is to keep your case file in Guyana and secure another interview.

2. Write down everything you/your fiance were asked during the interview and your responses to those questions. You WILL forget the details later and this is important info if you need to appeal the denial.

3. Your visa is not actually DENIED, its being recommended for review at NVC and you WILL be given an opportunity to submit more evidence if the petition is returned to the US...but you want to avoid that at all cost.

4. You may want to contact a GOOD attorney that SPECIALIZES is denials. I found one on VJ website and another on my own. Both were good. I'm going to find you the contact info for the second guy b/c he was very reasonable ($150 or so to review your case) and he gave me tons of advice by phone. I spoke to 4 attorneys here in Atlanta and got some strange repsonses and some didn't know what to do!!!!

First off - thank you all for your suggestions. But I have a question - why is it important to keep it there? I really don't have a mind to deal with those guyanese people anymore that work in the embassy. The embassy told my congressman friday that they are sending it back because they don't think we have a real realationship. But they never kept any of my phone bills - all 2000$ worth of phone calls to HIS NUMBER ALONE!!!!

So tell me why it's important to keep it there please???

It's very simple.

1. Any eventual K1 visa will be issued by the Consulate in Guyana.

2. USCIS will most likely do nothing but let the petition approval expire.

3. You won't know USCIS did this for several months, at which time you'll be starting over.

4. See 1. above.
