Hi

From everything I've read about DCF the residency requirement falls upon the USC, not the non-USC spouse.

Is it thus possible to do a DCF when the non-USC is not located in and has no ties to the country where DCF is filed?

I suppose the most obvious problem will be for any actions that need to be performed in person, particularly the consulate interview.

Could she somehow do the interview in her home country? Or must she come to the country where I am resident for the interview?

Anything else wrong about this approach?

The particulars of our case:

I am USC, legally resident in Israel for 4+ years, should have no problem at all proving my residence here.

She is Thai and lives in Bangkok. We are not even married yet. I have actually been approaching this as a K-1 fiancee filing, but the concept of a faster DCF filing in Israel has grabbed my attention.

If we got married in Bangkok could I then return to Israel and file I-130 locally in Jerusalem for her although she has absolutely no status in Israel?

We did get her an Israeli tourist visa last year when she came here to visit me, so I suppose I could get her another visa for purpose of entry to Israel for the interview.

How much faster is a I-130 in Jerusalem likely to be than a K-1 via CSC and Bankgok interview process?

Some consulates accept USC petition for a non resident of that country, some do not. You need to find out from the US consulate in Israel whether it's possible.

Other than the residency requirement for USC, another general requirement is you need to maintain domicile in the US.

08/28 Submitted civil docs & paid $400 IV fee. Visa Interview & approved !!!

08/29 Visa in hand

09/30 POE IR1 visa interview took 166 days from the I-130 filing date (expedited).

10/04 Applied for SSN in married name.

11/11 Welcome notice received (dated 11/04)

11/15 Received Green card.

11/21 2nd Welcome notice received (dated 11/13)

11/24 Received SS card in maiden name.

In the case of filing DCF in Jerusalem, she would have to be married to you and residing in Israel. In order for you to file DCF in Bangkok, you would have to be a resident of Thailand.

I don't think going DCF is a good option in your particular case.
