Me and my husband to be want to move to the US through DCF. I (foreign spouse) have a study grant (worth $2.000,- a month) that I will be taking with me. Very nice gift from the Dutch gouvernement. We have been travelling, living the life, a lot so we pretty much have no assets.

My American citizen man wants to try to get a job (offer) in Las Vegas before we leave for the US. We do not have a sponsor.

Would my "income" combined with a letter from an employer be enough for us?

Another thing my irresponsible husband did not do was to keep in touch with the IRS. Can he still do that? I think I've read that he could on this forum.

I hope someone can help me. I have read so much but with every answer a new question arises

As far as I know, a job offer is not enough, he would need to be employed already. But if he can get an offer now, he can move to the US as soon as you are married and have filed the I-130 via DCF and start that job. Taxes can be back filed.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

The foreign spouse's income usually is not considered, but since your grant will be a source of income that continue after you migrate to US, it may be.

He can file the DCF, leave for the job and by the time interview comes around, hopefully he has a letter from employer says he is employed, annual salary etc.

Another thing my irresponsible husband did not do was to keep in touch with the IRS. Can he still do that? I think I've read that he could on this forum.

That sounds extremely familiar.:-) He can file now, backdated. He won't be taxed unless he earned more than $85k yearly, if not mistaken.

I hope someone can help me. I have read so much but with every answer a new question arises

So if I understand you guys correctly. What we should do is:

1. Back file taxes

2. Get married

3. Get a job offer

4. File at the embassey

5. USC goes to US to start work

6. When interview he comes back with letter employer

Did I pass? Am I correct? :dance:

My question is, will it not cause problems if he leaves for the US? Can we than still do the DCF? I know we are already in the process by that time but will it not be a problem?

Yes, you got it.

He needs to be there to submit the I-130 and supporting documents during the initial interview.

After the I-130 is approved (usually within a few days for DCF), you guys will receive packet 3 which require the petitioner to submit affidavit of support and the beneficiary to submit the visa application and civil documents.

After that, you get an appointment for visa interview and medical check up.

This can be done without the present of the petitioner. He doesn't have to be present for the visa interview.

That you all so much. Your help is priceless.

I have received an e-mail from the Embassy in Caracas that we can apply DCF so that is great.

Also and this is maybe usefull for someone else, My husband to be only has to proove that he was in the country for 6 months and that he has a legal status at the moment he files. So in venezuela you do not have to be a legal resident for 6 months.

I will start with gathering documents this Monday.

BTW Am I wrong to assume that DCF can actually happen in a matter of weeks?

I read that in a few places but then I see that most of the people on the forum have been waiting for months.

Anyone know what a realistic timeline is?

Totally depends on the embassy/ country you are in. There is a group of June DCF files on here, and one already got their visa, took about a month. I have my interview this Thursday and if I get the visa there and then, it will have taken me just short of 6 weeks. I think 6 weeks to two months is realistic, though some take longer, especially if you have AP (administrative processing, ie name/ security check) after the interview.

Well that would be insainly good. Thank you guys for all your help. I'm gonna file. I'll put all my info on here and then I wil probably come back with many more questions :thumbs:
