Question Regarding Hardship Case?

Hello All,

I am curious if this would be considered a hardship case:

I'm sure a few of you have heard about the recent events along the Thailand and Cambodia border. Well my wife's residence in Thailand is about 20 minutes from this area, I even tried sending money to her but the place was closed down do to these events, do you believe this would be considered a hardship case or reason for an expedited process?

I tried to get the process expedited prior to these recent events, I received an email, should I reply to the email with this new information? Would this hurt their chances since I have been denied? Just curious if it would be to our benefit to even attempt.

i think it might. your best bet would be to also talk to your congressman and see if they can help expedite this for you. yours seems to be a genuine case.

Get a congressman office who is willing to help you to apply pressure and talk to the congress liaison officers at USCIS .

Our expedite request for I-130 get approved after much effort of the congress aide who kept bugging them, called them daily (you can see we have many touches after the congress aide called !).

Thank you for replying to my post, I will try to type up a letter and mail it off.

If you believe you have a strong case deserves expedite processing, you need to have documents to support every claim, leaving no room for USCIS to wiggle.

You can call the congressman office, talk to their aides who are in charged of immigration. Find one who is willing to help.

They will email/mail you a privacy form which you have to fax/mail back to them before they can help you.

You then sent your letter and all the supporting documents to them, so they can fax to USCIS.

The aide who helped us also got a letter signed by the congressman to support our "expedite request". He also talked to the immigration lawyer who works for the congressman office for advice on what documents we need to submit.

I am sorry, I haven't heard of what has been occurring there.. what I can say is, you should reply to the email and along with it provide evidence as proof. Many of our spouses are living in countries with turmoil, but that in itself is not enough for USCIS to expedite your case.

If your wife is in harms way then this is what you want to concentrate on finding proof to include with your email. Pictures, maps, news articles of recent problems that are naming the city or area where your wife lives or works. This will make your case strong.

i am sorry to hear the hardship that your spouse is dealing with. i dont blieve USCIS accepts electronic artifacts as evidence to approve expedite cases. just as someone mentioned before, you will need to provide hard copy proofs like new articles, or perhaps a letter from a non-profit organization (like red-cross) who is serving the affected area.

Sorry, I couldn't find a warning on the Department of State website, but there is an official warning about the area put out by Canadian Foreign Affairs. I am sure with a little searching you may be able to find something on the Dept of State website as proof.

When I contacted the senators, congressmen/women, U.S. State Department, I sent them maps and articles from different resources, thank you again for your advice, I hope it works.

Thank you for that website, I never thought about using it before, but I did when I contacted senators, congressmen/women, and the state department. It actually opened up a window in my head for additional resources.
