My brother-in-law who is a Permanent Resident has been sponsoring his mom(who is a widow) for Visitor's visa and she was denied a visa the third time a month ago...Everyone is quite upset.. :unsure:

She does need an interpreter since she is not fluent in English...

I believe she had sufficient property and assets to show she has ties at home...

Being a US Citizen, I want to step in and sponsor his mom.

Would it be possible for me to attend her interview in person if she were to go the fourth time? would that make any difference? Does Chennai consulate allow petitioner's to accompany the applicants?

Anyone with similar cases, please share your experiences..Thanks for your replies.. :thumbs:

Did they tell her why she was denied? My in-laws interviewed for a visitor visa at Kolkata and they got their visa but others who were denied were told exactly why they were denied and what (if anything) they had to do to overcome the denial.

Whether you sponsoring and/or attending the interview will help or not depends on the answer to that question.

The visitors visa is a burning issue right now because lot of people on visitors visa dont go back and especially close relatives. I dont think she would be allowed to have a person with her. The consulate usually and most of the time have indian interpreters with it. Actually the problem is that you shiver during in the interview. I was shivering during the interview and my voice was mumbling while answering. The best thing is you can co - sponsor only if it is required to.

Feb 1,2007 - I-130 Reached USCIS.

Feb 4,2007 - I-130 accepted > Get USCIS case Number NOA1.

May 8 ,2007- GET NVC Case Number > NOA2.

June 16 ,2007- Get Order from NVC to pay 70$.

July 2 ,2007- Get DS-3032 in India.

July 7,2007 - DS-3032 choice of address agent entered in NVC.

July 14 ,2007- Get I-864.

July 18 ,2007- I-864 Enters NVC.

July 29 ,2007- Get Order to Pay 380$ fee.

Aug 3 ,2007- 380$ Fee Reached St Louis.

Aug 25,2007 - NVC & St Louis People receive photocopy of my payment with USPS receipt.

After WAITING for 37 days.

Sept 10,2007 - 380$ fee encashed.

Sept 24,2007 - Receive DS-230 in Mail.

Sept 25,2007 - DS-230 despatched.

Sept 26,2007- DS-230 Delivered.

Oct 1,2007 - NVC has DS-230.

Oct 12, 2007 - DS-230 Reviewed. Case Complete

Oct 16, 2007 - Case at Embassy.

Oct 25, 2007- Interview Letter Despatched from Embassy.

Nov 3, 2007 - Recieved Interview Letter.

Dec 1, 2007 - Medical Exam .

I GOT IT

Jan 16 - I am in USA

April 15 2008 - Get my Drivers License.

I-751 Lifting Conditions at California Service Center

November 12, 2009 - I-751 Sent via USPS Express Mail

November 13, 2009 - Receipt of I-1751 Fee

November 20, 2009 - Arrested on Domestic Battery(Had argument with wife)

December 18, 2009 - Biometrics Completed at 9 am.

January 13, 2010 - Receive I-797E Notice for more evidence

February 16, 2010 - Mail reaches Californa Service Center( Next day of Preseidents Day)

February 19, 2010 - Card Production Ordered. Status now IR1

Nope...She got the standard reply everytime she went thro' and as I said,she doesn't understand English quite well..so, all we are looking for is a checklist or documentation from the consular office but they don't provide that...

When your in-laws were interviewed, where you able to go with them in person?

I don't have statistics nor you but I beg to say not all(or most) of close relatives end up staying in the US..that's been a rumour mill for several years now..staying illegally in this country means you lose a lot of benefits and I don't want to go there as thats not why am here...

But you are right, my BIL's mother probably wasn't confident or the whole process scares her hence, my desire to accompany her...

As i said, I don't mind sponsoring but am wondering if my presence would help the applicant and if the Chennai consulate allows petitioner's to accompany them...

Unfortunately, you can't. However, if your BIL naturalises it becomes much "easier", as he can then do so.

(Pras would also like her mum to come over--so we're filing I-751 this coming Monday 2008/07/21, and counting down days till she can submit N-400).

BIL's naturalization is another 4 yrs away. Why do you say I can't sponsor her for Visitor's visa?....I believe US Citizens or for that matter US residents can sponsor anyone as long as they show they can support the applicant and that, the applicant will not become public charge...Is my thinking wrong?

For a visitor's visa the burden is on the applicant to prove sufficient ties to return home. It has nothing to do with who is sponsoring her.

Unfortunately, your BIL's naturalization will do nothing to prove that his mother is going to return to India.

Maybe you can have him try to find out why she keeps getting denied and then you can try and remedy that.
