Hello need help please!

First I would like to say hello to every one and that I am glad I found this forum I have learned alot of info.

My name is JT my wife's name is Natasha.

okay here goes Natasha came to America In April 2007 on a J1 Visa, we met out you know the rest. She was suppose to leave Sept 11, 2007 but she missed her plane, so she stayed here we were married in Jan 2008, and a few weeks after we were married her mother died, so she went back to Siberia for the funeral on February 25, 2008.

I am trying now to file I-130 and K Visa I wanted to know If she is gonna have problems because she overstayed on her visa about 140 days?...................Also wanted to know if it would be better for me to go to Russia and re-marry her in Russia and go to embassy there, if that would be quicker for her to come back home to America with me?

Thanks for any insight to my problems

Nothing is quick....

Married is married... where it occurred does not speed it up

If a ban to re-entry is in place (I think the threshold begins 180 days) you can always apply for a waiver...

File the petitions and get the process started!

No need to get married, you already are. The only way you going to Russia might be quicker is if you are able to stay thee for 6 months, as you can then file DCF.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.
