Seeking IR 1 information

I have been looking over the USCIS web site for a legal definition of IR 1 status. Maybe I am not searching the right way! If anyone knows of a link without having to search for it, I'd really appreciate your help. I need to take a printout just to be on the safe side, for travel purposes.

<rant> I went back to Chicago this week to get a stamp that my I-751 is approved (although they messed up the name). The officer cancelled my previous 1-yr stamp (with the pending I-751 notation), but gave only a 60-day stamp with IR 1 notation :angry: I did not think to take the memo that says we are eligible for a 1 yr stamp because I already had a 1-yr stamp. He said it looks like my I-90 is being worked on and that I should receive it soon. But, he was also clueless about Nebraska filers being transferred to CA, that I do not trust what he said.

The I-751 has now cost us an added $100 dollars in travel/mailing costs and in the loss of two days off my annual vacation leave. It is amazing that USCIS is basically not accountable to anyone (other than the court system maybe!) </rant>

I don't know if this will help, but here is the statement of need for the conditional requirement from the USCIS Adjudicator's Manual. You might want to search the manual in more detail to see if you can find something more specific to your needs:

(K) Immigration Marriage Fraud Amendments of 1986 . In an effort to deter immigration-related marriage fraud, Congress passed the Marriage Fraud Amendments of 1986 on November 10, 1986. This legislation had a major effect on the adjudication of relative petitions, including:

• In many cases, certain conditions had to be met prior to the acceptance or approval of certain petitions on behalf of spouses (see paragraphs ( L ) and (M).

• Criminal penalties were added or enhanced for individuals who were convicted of having engaged in a fraudulent marriage.

• An alien’s lawful permanent residence is “conditional†if the qualifying marriage occurred less than 2 years prior to the alien’s immigration or adjustment. The provision requires that a conditional resident alien seek removal of the conditional basis of the residence shortly before the second anniversary of the date on which he or she immigrated or adjusted (see Chapter 25 regarding removal of conditions).

Chapter 25, which is the relevant chapter on Removal of Conditions only starts at 25.2. 25.1 is about the Marriage Fraud Act that would probably contain the information you require, however it is not currently available in the manual.

Thanks for the link! I looked around some more, but could not really find the exact wording. You're right that it is probably in the missing section. I'll see how my travels go in a couple of days!
