Here's my situation, My daughter and I filed at the same time (AOS)but she got her GC B4 mine. We are more than 90 days apart. Can we file I-175 together to save money?since the time I will file my I-175 her's will be expired by 7 days.

You meant I-751. Your daughter can be included in your I-751 so long as you and your daughter arrived together in the US. Filing fee is $465 + two $80 biometrics = $625 Total.

I've read a couple of cases where they missed the deadline - but not on purpose.

I definitely recommend shelling out those extra dollars.

Is the money you're going to save worth the risk of your case ending up on the desk of an officer who is having a bad day or too much caffeine?

USCIS is very specific with the 90-day window. IOs even emphasize this after the AOS interview.

My step daughter got her green card about 2 1/2 months later than my wife due to a USCIS mixup, but I put her on my wife's I-751 anyway and applied 90 days before my wife's conditional card expired. Al worked out well, daughter and wife received their new ten year cards at the same time, with the same expiration date. They are back in sync again. Ha, but not for long, wife is going in for her citizenship interview tomorrow, daughter has to wait another two years, but that is her fault for turning 18.

Ha, a question I was afraid to ask, why are the kids also put on conditional status, they didn't have anything to do with the marriage. And what happens if the marriage does break up, and the kids want to stay with the USC? What the heck, a nice home, their very own computer, a car, money....

LOL. My daughter will definitely agree. Hubby's the cool stepdad with the cool car and knows all the cool stuff. I have been demoted from cool single mom to a not-so-cool mom to a so-not-cool fobbish mom with an accent B)

Incorrect! The child beneficiary can only be included on the parent's I-751, if adjustment of status for the child was approved within 90 days of the parent.

Surpisingly enough, the child is subject to the same requirements as the parent..that the marriage through which their status was conferred was bonafide. If the marriage terminates or the parent is unable to demonstrate to the Service's satisfaction that the marriage is bonafide, the child's status is in jeopardy as well.

Yeah diadromous, those are the agency rules and just seven days over is a bummer. Too many laws and many where one agency contradicts that of another agency, I have both written and talked to my congressman and senator about some of the hardships and really no benefits of these many laws, but trying to even learn what 1,525 different government agencies are doing is impossible for anyone person. The bible is very correct when they said the offspring have suffer because of the sins of their parents, but the bible really didn't have to say anything that is that obvious.

I can't even recall that 90 day rule but that was quite awhile ago for us with the I-751, and "My daughter and I filed at the same time (AOS)but she got her GC B4 mine." If they filed exactly at the same time, who's fault was it that the cards were issued 97 days apart?

I would advise you to file the I-751 close to the end of your child's 3-month period, and just at the beginning of your 3-month period, with an attached note emphasizing that the I-751 is for both.

The worst that can happen is that you will be asked to submit a separate form and fee for your child.

I've encountered this issue before, but I can't recall how exacting USCIS was about "counting" the days.

By submitting the I-751 first to include both mom and the child, and see what happens.

Yes we filed together at the same time our AOS last 2006,we send it to NEBRASKA and she got hers early and my papers they transfer it to CA.

I never thought that 97 days gap is really big deal for our filling our I-751 specially on the FEE.It would be different if I received my GC first.
