Hi everyone

So i have some questions because i would like to have a clear idea of what it's gonna happen:

Me and my wife got married in CT, of course we had to get the marriage license to the TownHall of the place we wanted to get married.

We live in MD, we still have our original Wedding Certificate, but to send out the stuffs for the AOS we need more.

What we did is to send a check to the townhall to get a couple of certified copies of the certificate (we asked for 4 copies, we sent 40$, 10$ each).

So, i came in here the 16th of may (2 months ago), we still don't have our certificates, the AOS is almost there to be sent but now we can't, plus i'm having a lot of trouble finding a job, i flew to JFK and i got the stamp on my I-94, but to go on what we saved for the EAD (1013$) is almost all gone in bills and food.

My question is: if i find a job tomorrow, to start as soon as possible (i sent out a billion of resume) do i have to work when my I-94 expires (14th of august)?

What happens if we can't make it to send the AOS for we don't have the thousand $ to pay the fee, in time before the 14th of august? And i don't have the money for a ticket to get back to my Country...

any suggestions please?

Don't worry if you can't file for AOS before your I-94 expires, so long as you got married within the 90 days of entry you can stay with no problems and apply for the AOS and new EAD at your leisure. However, you will not be able to work past the 90 day limit without a new EAD which you can apply for when you adjust status at no additional charge if filed at the same time as the I-485.

There's no pressure on you to find a job, this doesn't affect your AOS or EAD application at all as you will are sponsored by your partner and/or co-sponsor. So long as they are earning 125% above the poverty level and can fill out the affidavit of support you won't have any issue.

Like Darren& Laura said, don't worry about not filing for AOS before the I-94 expires. The only problem is that you can't leave the Country until you filed for AOS and got your Advance Parole.

I also believe it will be much easier for you to find a job when you will have an EAD.. but you have to wait for your marriage certificate unfortunately..

You saved on EAD?

Do you mean that by flying into JFK you got the stamp, so that saved you the $1010 for the EAD?

I think you are a little confused. The stamp you received at JFK is only a temporary work authorization. It expires the day your I-94 expires, there's a date written in there. You still have to apply for the EAD if you want to be able to work.

The $1010 fee is not for EAD, that's the fee for filing the AOS. The EAD is free if you file it together with AOS.

Good luck on finding a job, it's pretty rough out there right now.

For the AOS, you don't need an original certified copy of your marriage certificate, you need just a photocopy of your marriage certificate. You say you have the original marriage certificate, just make a copy of that for the AOS application.

no, didn't get me... i got the temp stamp, but not finding a job brought us to use the saved money for the AOS+EAD+AP application to go on and survive.. that's what i meant..
