Hello!

I am considering the K-3 process and I have a few basic questions to start with.

Any info would be very much appreciated!

My partner and I are not married or even engaged but are considering the possibility that we might want to get married spur of the moment when he comes to visit the USA this fall.

Does anyone know if K-3 will be right for us if this happens?

Is it possible to get a marriage license in the USA when the non-USC is simply visiting on vacation from a Visa Waiver country?? Or, must they have a SS# etc etc??

Why are you not considering CR-1?

For UK CR-1 is taking about the same time as K-3. (Compare timelines)

Does your spouse wish to work when they arrive in the USA? CR-1 CAN take a job, K-3 CANNOT, work until after getting an EAD or their Green-Card, EAD can take 90 days or more to get.

CR-1 results is a green-card upon entry which allows WORK, Getting SSN, and Applying for Driver's license, K-3 requires filing AOS ($1010) and for EAD if wish to work, get SSN, and Driver's license while waiting for green-card.

In most states SSN is not a requirement for marriage license.

If you do decide to get married, just file for the CR1 visa. Yes you can get an adjustment of status from a tourist visa. Get a good lawyer to handle it for you.

Visas are used to enter the US. If already here and you truly get married on the spur of the moment, he needs no visa unless he wants to leave the US and return a few months later. He can just stay and adjust status. You're walking a fine line though. Considering a spur of the moment marriage before he's even here doesn't actually sound like a spur of the moment decision to me and might not to USCIS either.

Facts are cheap...knowing how to use them is precious...

Thanks to everyone for their responses!

We are still unsure if we will get married or not. It's more that we think we might end up getting married considering our entire situation/connection so far seems to be a pre-written script and we are just playing the parts :P

I was only trying to see what our options are in case we do end up getting married.
