I am a USC and my mom just recently became a resident. My sister is over 21 but not married. I know my mom can apply for her but I can't find any topic on the subject on how to apply, and how long it takes.

Would someone share the experience?! Thank You.

As of right now your mother can't apply for your sister since she is not a US citizen. There is no visa category for children over 21 of LPR. However there is a visa category for a sibling (brother/sister) of a US citizen which means you have to apply for your sister. You can go to www.uscis.gov website and look up form I-130 and the instructions for it.

Your other option is to wait until your mother becomes a US citizen and then file in the category of children of US citizen over 21. You can look up processing times online on the uscis website also for all visa categories.

I would have to correct myself, there is a visa category for children over 21 of a LPR. The rest of the process is the same. Form I-130.

This is false!

Second family sponsored preference is for unmarried sons and daughters over 21 of permanent residents.

Your mother can submit an I-130 application.

Brothers and sisters of adult USCs is fourth preference and will take much longer.

Have your mother petition. Upgrade the petition to first preference if she naturalizes while the petition is still pending.

Your mother can petition her daughter as an LPR, just need to file the I-130 with necessary documents. It will take the USCIS about 5+ years to approve the petition and then it will be forwarded to the NVC while a visa # is available for her. This can take another 5-10 years.

My aunt filed for my cousin (her son) about 10 years ago and he's still waiting for a visa number.

I know, it's crazy. But if your mother tries to become a US citizen, things will be a lot faster as long as your sister doesn't marry.

Thank you very much. How do I know how long it takes for each country ?! Thanks once again anyway.

Any idea on how long will take now for AOS?

Since the beneficiary is above 21, that person is considered under F2B Category.. THe bulletin says priority date of 15DEC99 .. Id say 8 yrs? Hopefully less...
