Timeline

I am going to apply for my wife after a failed try for K-1 last year. The K-1 petition was sent back to NVC and after a congressional enquiry UCIS wrote to the senetor's office that the case is over 4 months old and is closed and the petitioner may choose to apply again.

I went back to India and got married.

section D.2 of form I-130 ASK FOR IF YOU HAVE EVER BEFORE FILED A PETITION FOR THIS OR ANY OTHER ALIEN.

What should I do?

Advice needed.

Also I do not have my birth certificate. I never had one. I am a naturalized US citizen. It that a big deal.

Can I send the completed form and documents by next day express mail to the P.O. BOX address in Chicago? What is the prefered mode.

Can I send the personal chack?

Please advice me.

From what I understand being honest is the best policy... they will know you filled a petition before eventually so be up front is my suggestion.

Also the Birth Certificate is a good question but I know you can send all pages of your passport in it's place but eventually this maybe a problem. Perhaps someone can chime in with more info than me on it.

good information there for steps and how to fill out paperwork. But I sent mine overnight and requird a signature so I can keep track as best as possible. They do accept personal checks.

Not a problem for petitioner.

The instruction says:

Copy of the full Birth certificate (front and back) for the US Citizen OR a copy of ALL pages of the US Citizen's passport. This is used to establish citizenship.

08/15 Picked up packet 4 & medical check up

08/28 Submitted civil docs & paid $400 IV fee. Visa Interview & approved !!!

08/29 Visa in hand

09/30 POE IR1 visa interview took 166 days from the I-130 filing date (expedited).

10/04 Applied for SSN in married name.

11/11 Welcome notice received (dated 11/04)

11/15 Received Green card.

11/21 2nd Welcome notice received (dated 11/13)

11/24 Received SS card in maiden name.

I will send my naturalization certificate as well as the copy of the US passport.

One more question. If I go thru an attorney doed that mean my wife will not get DS-3032 form to sign.
