hi there motslan,

first of all welcome here in VJ..

First things first..

unfortuntely, it doesnt work that way, i mean your girlfriend being in US in a tourist visa.,. you cant marry her in the US.. what you would do is for her to go back to her country and get married there file for k3 or cr1 visa or dont get married yet,but still she has to go back to her country and you have to file for the peititon of k1 visa meaning your petitioning your fiance..

after your filing it may take some time and you have to be patient and all.. first though you havet o make a decision if you would like to get married or not yet.. if you want to be with her in the US as soon as possoble i suggest you the k1.. and take it from there..

Yes, you can marry her. As long as she has her birth certificate and passport, you guys should be fine.

17 June 2005- entered US on tourist visa, I came to visit my boyfriend. We hadn't seen each other for 9 months.

18 November 2005- We got married!!!

8 December 2005- we sent I-485 package to Chicago

16 December 2005- notice date for I-485, I-130, I-765

28 December 2005- biometrics appointment letter

11 January 2006-biometrics done

1 April 2006- finally got EAD

7 April 2006- applied for SSN

6 May 2006- SSN arrived

26 June 2006- got my driver's license

17 August 2006- got my interview letter!!!!

02 October 2006 11:30- we had an interview and we were approved!!!

07 October 2006- I got my Welcome Notice

14 October 2006- Permanent Resident Card Arrived!!!

12 July 2008- I-751 sent

17 July 2008-check cashed

19 July 2008-NOA from VSC

8 August 2008- biometrics appointment letter arrived

9 August 2008- request for rescheduling sent

as long as she didnt get here on a tourist visa with the intend to get married and stay you can marry her and then file for aos (adjustment of status) to get her green card. if she got here on a tourist visa with the intend to get married and you do so its called visa fraud and if the uscis would find out then she would be banned from the us.

I'm not an expert on the subject, but I agree, you can marry her as long as she didn't come to the US on a tourist visa with the intent to marry. You will have to prove that, if I'm not mistaken. I don't know how, you would have to talk to someone in a similar situation. Of course, you can also go with K1 or K3, but that's definitely a longer route. Once you marry she will have to adjust her status (AOS) to get her residency. Her residency, if granted, will be for 2 years. This is done to help prevent fraud. After 2 years she will apply to lift the condition of her GC. You will have to prove your marriage being bonafide. There's a long way ahead of you no matter which path you take, but we're all on it, so good luck! Where in Poland is she from?

she came to the us to visit her great aunt in california and to see a few citys while here. she didnt expect to find her soul mate, but im glad she did. so this shouldnt be a problem with what you you guys are saying.

I didn't have my birth certificate translated when we were getting our marriage license. They just wanted to look at it. However, she will need to have it translated when you guys will send your papers to USCIS. I had my translated by polish priest, and it was ok.

Cool! Gdansk is a really cool city. And my hometown is probably 2 hours away from Radom. As for the birth cert, you can get a sworn translator to translate it. The way they do it looks very professional. Just have her family take care of it in Poland. We have a Polish-speaking thread on this forum (up top, stickied), you can invite her to join and chat with us. There's another girl from Gdansk there. :)

I think getting a sworn translator to translate it, is a waste of money. For AOS I translated my husband's birth certificate, and got it notarized for free. If your fiance is fluent in both Polish & English she can do it herself and save the $$.

Gdansk is beautiful! That's the area where my husband is from.
