Hi All,

My freind's husband whose 1-130 is approved and his case is at NVC now, just moved from his native country, Afghanistan to India for some security issues and stuff. He decided not to go back to his country and wants to transfer his consulate processing to New Delhi where he lives now on a visitor visa.

Is this possible to get his interview at New Delhi now? Or does he have to go back to Afghanistan?

Anyone has or heard any similar situation? Please help and reply.

Your friend will need to contact the consulate in New Delhi to ask them if they'll accept the case.

Different consulates have different rules about what cases they'll accept. I believe they'll always accept cases from citizens of the country where they're located, and I think they'll always, or almost always, accept cases of people who have permanent resident status in the host country. Some consulates will accept cases from any visitor who happens to be in the country, but many will not. I have no idea what the rules are in New Delhi.

Because someone might bring it up, I'll note that, by law, a K-3 case must have the interview in the country where the marriage took place (unless the marriage happened in the US). But there's no such law regarding an IR-1 or CR-1 case. An interview for CR-1 or IR-1 visa can happen in any consulate that will accept the case.

I don't know how to manage the logistics of getting the case transferred, but once you get the people in New Delhi to agree to accept the case, they can probably tell you what, if anything, needs to be done to get the case into their hands.

19 Apr, 2004: I-129F Sent to MSC

29 Apr, 2004: I-129F NOA 1

13 Aug, 2004: I-130 Approved by CSC

28 Dec, 2004: I-130 Case Complete at NVC

18 Jan, 2005: Got the visa approved in Caracas

22 Jan, 2005: Flew home together! CCS->MIA->SFO

25 May, 2005: I-129F finally approved! We won't pursue it.

8 June, 2006: Our baby girl is born!

24 Oct, 2006: Window for filing I-751 opens

25 Oct, 2006: I-751 mailed to CSC

18 Nov, 2006: I-751 NOA1 received from CSC

30 Nov, 2006: I-751 Biometrics taken

05 Apr, 2007: I-751 approved, card production ordered

23 Jan, 2008: N-400 sent to CSC via certified mail

19 Feb, 2008: N-400 Biometrics taken

27 Mar, 2008: Naturalization interview notice received (NOA2 for N-400)

30 May, 2008: Naturalization interview, passed the test!

17 June, 2008: Naturalization oath notice mailed

15 July, 2008: Naturalization oath ceremony!

16 July, 2008: Registered to vote and applied for US passport

26 July, 2008: US Passport arrived.

They will need to fill out an I-824 (Application for Action on an Approved Application or Petition) and pay a $340 fee. They may want to call USCIS to make sure they don't need to do anything else other than that.

Received NOA1 in mail: April 29, 2009

Biometrics Appt: May 13, 2009

RFE: May 11, 2009 (received May 14, 2009)

Sent in RFE (that we had already included in the original packet!): May 26, 2009

Resumed Processing: June 1, 2009

EAD Card Production Ordered: June 10, 2009 (thank you GOD!!)

Received EAD card: June 20, 2009

2nd Daughter Born: July 13, 2009

Interview Date: July 31, 2009...easy, breezy...Card Production Ordered!

Received 10 year green card : August 14, 2009

Baby Boy is born: May 17, 2012

Apply for Citizenship: October 22, 2012

Interview: January 11, 2013

Oath Date: April 12, 2013 (Covington, KY)

done Done and DONE!!! Praise God!

Now we get to work on getting his family to the US!!

Thank you so much all for reply! I think it seems more complicated that we had thought. She is so confused that she hasn't done anything so far. The case got approved in only two months and now things are getting complicated by thi suntimely relocation. :innocent:
