Hello all, do you think we can get my wifes drivers liscense renewed with and expired green card and her one year extension letter? It expires the same date as the green card and all we have is the extension letter. Thanks for your help

Can you get your drivers' license before it expires, and therefore before the greencard expires?

All depends on if DMV office will accept the extension letter or not, this varies by state.

Some DMV will accept a SSN that has no notation on it, and other forms of ID to renew. For example, NYS, issues a DL that is Valid for 5 years, and only have to pay fee to get it renewed, it is NOT tied to residency.

I don't know about Oklahoma, but Georgia has no problems accepting the NOA letter. Be sure to point out the sentence that states it extends your greencard status for a year - don't assume they will read it. Good luck.

This is something you don't know until you try. I as a US citizen since birth receive a letter from the DMV that my license has to be renewed, go in, take an eye test, pay the thirty bucks, and walk out with my license.

Wife goes in with the same letter and her driver's license looks exactly like mine, they ask her to prove residency or US citizenship, she shows them her expired green card and one year extension, they refuse to renew it, what the hell is a one year extension. I get steamed, contact Jim Doyle, he puts me in with the state's immigration office and the head of the DMV, we talk on the phone, and I am sending faxes why the USCIS is so slow, but I did have letters from both Sen. Feingold and Congressman Obey that they are helping us with our case. At first they were going to just renew until her one year extension expires, I said, not good enough, then they agreed to renew her license for the full eight years.

Two months later, our daughter goes in with that same letter, but has her ten year green card, finally came in. They never ask to see her card, again her old license looks like everyone elses as does the DMV letter, pays her 30 bucks and walks out with an 8 year license.

We have a small DMV office and the state sends their DMV personnel here, I don't know from where, the only difference I noted between my wife and daughter, a different clerk handled my daughter. Just like the USCIS officers, get a different story each time you talk to a different one. Really don't know what's going to happen until you go in, and how lucky you are with whatever clerk you happen to get.

Do different states issue licenses for different time periods? I just checked my own license due to this discussion in case it was about to expire. It looks like it is a 6 year license and won't expire until 2012 and is a tx DL.

I-130 for both parents

March 28th 2013 - Priority date/ NOA 1
November 14th 2013 - Transferred to Nebraska Service Center

January 7th 2014 - Case changed online to approved for both

January 8th 2014 - case changed to shipped to NVC

January 9th 2014 - case changed to NOA 2 mailed

January 10th 2014 - Received the hardcopy of the NOA 2 stating that NVC would issue a case number in 30 days approx.

January 21st 2014 - Case Received at NVC

February 26th 2014 - Case numbers and IIN number received - Wrong embassy code assigned...now waiting for new case numbers.

March 3rd 2014 - Filled in DS-261 for both parents

March 5th 2014- AOS available, paid and submitted AOS packet.

March 6th 2014 - USPS shows packet was delivered at NVC

March 10th 2014 - AOS shows as paid in the CEAC portal/AOS logged into system as being received by NVC.

March 11th 2014 - New case number assigned for my Dad.

March 20th 2014 - Paid IV fee for my Mum.

March 25th 2014 - AOS accepted by NVC with no checklist.

March 26th 2014 - Filled in and submitted DS-260 for my Mum

March 31st 2014 - AOS found in my Mum's file for my Dad - accepted and placed into his file/IV fee available for my Dad and Paid.

April 1st - Mailed all civil documents to NVC for both parents.

April 3rd: IV fee shows as paid in portal/submitted DS-260 for my Dad.

April 22nd: checklist issued for civil documents - NVC error ...

April 23rd: sent another certified copy of my marriage certificate

April 24th: Case complete! :)

April 30th 2014 - Medical scheduled for parents at Knightsbridge in London

June 11th: Interview at London Embassy - Approved :)

Driving is a privilege granted by state, NOT the US government, so license standards are determined by the state, NOT the US government.

One country with 50 different states and fifty different sets of state statues, ha, if you want to work as a prostitute or open a gambling casino, better go to Nevada, try that here and you will be in jail. The feds have some control, if they say 55 mph on the highway, states better comply, or they don't, won't get their fuel taxes back, kind of like blackmail.

In a reverse manner, the feds ain't doing nuttin about illegals, but immigration is strictly a federal matter, but the states are claiming the illegals are costing them plenty of bucks so each state is setting up different laws to deal with this problem, many states aren't doing anything about it, but the states don't have the authority to deport illegals, can only put them in jail for whatever reason and have to call the feds for the actual deportation.

When my wife and daughter received their first driver's license all they needed was their EAD card with that highly restricted SS card, but since they were new here, state would only issue a three year probationary license. As of the first of this year, needed very yellow green cards to renew their licenses. Governor appointed some guy to had state immigration, he was nice enough on the phone, but he didn't know a damn thing about immigration, the conditional resident card, how slow the USCIS operates, and a one year extension notice that I couldn't even explain. So I spent a week educating him. I did get a call on my answering machine from a woman that heads our DMV apologize for the inconvenience they caused us. Was thinking of sending them copies of our new ten year green cards, but said the heck with that, spent way too much of my time already.

Who really wants local control in government? Ha the guys that earn their living that way. Levels of government start at the city, then the township, then the county, then the state, then the federal. Think of all these freeloaders that could be dumped with a tremendous savings in taxes if all these middlemen were dumped.

Ha, if you decide to commit a crime, don't cross a state line, not only will the locals be on your tail, but the feds as well.

We had a similar problem with my wife's identification card (she doesn't drive yet). I wrote a letter to the DMV along with a copy of her green card and the extension letter. They gave her a new ID card with one more year. Now I'm trying to get her excited about learning to drive.

Now, I'm going to throw in a tangential question (note: we haven't submitted I-751 yet, but will do so next week).

My wife's non-DL ID from MVA has an expiry date of five years after issue (which was 2 years ago). If she takes driving lessons (and has it converted to a DL), will the new DL retain the old ID's expiry date?

I think she can renew her driver license, but it depend what state are you live in. The NOA show that the conditional resident status is extended for a period of 1 year, take this to driver license office. Some state will give her regular driver license, but some state don't. Good Luck.

Now, I'm going to throw in a tangential question (note: we haven't submitted I-751 yet, but will do so next week).

My wife's non-DL ID from MVA has an expiry date of five years after issue (which was 2 years ago). If she takes driving lessons (and has it converted to a DL), will the new DL retain the old ID's expiry date?

This is another state dependent question, you can walk into my state DMV and get a photo ID for seven bucks with a birth certificate or other proof of age, probably a green card now that is totally independent of the driver's license, can have both if you want.

Not that I have big ears or anything like that, when I was in with my daughter a couple of weeks ago, the guy ahead of us was rejected for a photo ID because he didn't bring proof of his address. Was told to go home and come back with a utility bill or something, Didn't know that utility companies were in the the business of providing confirmed addresses
