K3 approved, shall We pay fees for I130?

ok here is the situtation. my BIL's I129 has been approved. he went to his interview in Islamabad Nov 06 and he was told that the case has been approved and he will get his visa/passport in the mail. it has been so long and still hasnt gotten anything back. Someone told him that we should not pay all the fees for I130 because that will cancel the I129 and all this process will take even longer

please tell us if its unusual to be waiting this long since everything was approved in nov 06. secondly should we pay fees for the I130 greencard visa since one lawyer is suggesting it. thanks in advance.

Lot's of things would influence your decision on the I-130 but paying the associated fees to NVC will not cancel your I-129F. However, once the I-130 is on station at the Consulate, a K3 visa cannot be issued. The Consulate can, however, use the later administrative processing and security checks associated with the I-129F to replace any required for the IR1 visa. The benefit to you is that he would arrive with an IR1 visa, once any visa is actually issued.
