Question:

My fiance has been in security checks at DOS for almost 6 months now after his consulate interview. I called yesterday to get status. The lady said that he is still pending security checks and that the last update to his case was on June 17, 2008.

Does anyone know what an "update" means in regards to pending security checks with DOS?

Sept 2005 met online

Mar-April 2006 1st visit to Morocco

Feb-Mar 2007 2nd trip to Morocco

Mar 9, 2007 Official Engagement Ceremony

June 29, 2007 Filed K1

July 10, 2007 Received NOA1

November 13, 2007 NOA2 sent "Approved"

December 5, 2007 NVC sent our case to Casa

December 10, 2007 Casa received our case

December 23, 2007 3rd trip to Morocco

December 24, 2007 Packet received from Casa

January 30, 2008 Interview (interview went well, placed in AP for security check clearance)

February 4, 2008 K1 placed in security check per Dept of State

September 3, 2008 Call received from Casablanca to bring passport on Sept 4th

September 8, 2008 VISA IN HAND!!! WHOOHOOOO

September 13, 2008 Tarik arrives in the US

September 15, 2008 Applied for marriage license

Sept 18, 2008 Applied for social security card

Sept 19, 2008 Wedding Day!!!!!!!!!!

Oct 2008 received social security card

Nov 15, 2008 Filed AOS paperwork

Nov 26, 2008 received NOA for I-485, I-765, I-131

Dec 2008 recieved RFE, forgot to include my w2's and foreign birth certificate

Jan 12, 2009 paperwork transferred to California Service Center for processing

February 25, 2009 received Biometrics appt letter

March 12, 2009 Biometrics appt at 9am

March 14, 2009 received Advance Parole approval letter

March 25, 2009 EAD card ordered

March 28, 2009 EAD card received!!! yeah!!

April 23, 2009 AOS NOA approval received

April 25, 2009 Green Card received!!!! YIPPEE!!!!!

An update could be anything from an inquiry from the embassy to the DOS about the status of the case to one of the agencies clearing him. There may be multiple agencies, not just the FBI involved in which case they send the security checks out one by one waiting for the first agency to clear him before sending it to the next.

A better question next time you call may be how many more agencies have to clear him?

I am so sorry to hear you are now going through this. An update can mean someone looked at the file and stamped something on it basically it means "nothing /nada" until the security clearance is completed .

I assume you have already thought about how to get things moving , from my experience here is what I would advise :

1. write to the embassador - ask him/her what is happening ? and inform them you are about to get your congressman/senator involved

2. write to the chief consular officer - ask him/her what is happening ? and inform them you are about to get your congressman/senator involved

3. write to your congressman/senator and ask him/her to request for an update

4. In case you feel like preparing yourself to sue them and let a District Judge decides if 6 months is reasonable to wait to complete a security check(400 $ well worth spent) by requesting an FOA with CIA , FBI and Department of state

I have to admit my advise is not impartial I would like to see more visa applicants sueing the department of state because me think it is the only way for it to improve : more than 6 months to identify a potential terrorist/criminal does not make the US or the world a safer place... That 's my own personal point of view

In your particular case for example any reasonable person would think :since 06/29/07 DOS had plenty of opportunities to go through these security clearances (well before the interview date).
