Hello Everyone!

I just wanted to update my information with you all. My fiance's Administrative Processing was completed one month ago and when I contacted my Congress woman, she got the reply from the embassy that our case was sent to "Anti Fraud Unit" 'cuz the person who interviewed my fiance was not satisfied by the answers of my fiance.

Now what shall i do? I am very dissappointed. Please advise. It has been 11 weeks since the interview. How long do i have to wait? any ideas? what happens next? :help::crying:

What should i do? anybody here in my situation? please share.

Somebody correct me if I'm wrong (Geez I should just start using this as my disclaimer)

So what you're telling us is that the petition was sent back to the United States to be NOIR (Notice of Intent to Revoke)?

Was there anything strange that happend at the interview? Did your fiancé say something wrong? You may want to go over the questions and answers she gave, to determine what went on.

No, the case didnot go back to US. Actually! the person who interviewed my fiance thinks by looking at our engagement pics that its a wedding and not an engagement. He asked my fiance again and again if its a wedding. my fiance said no its an engagement.

Later he gave my fiance a blue sheet, checked "this case needs administrative processing according to section 221g".

I called washington and came to know that the administrative processing has been done on april 10th and the case still pending and the consulate has not made the decision yet. :crying:

Later i contacted the congress women on may 6 and she got a reply from the embassy that this case has been sent to the anti fraud unit and they will contact my fiance after they receive documents from the anti fraud unit. I spoke to an immigration attorney and he told me that nothing to worry it takes about 30 days for the enquiry.

Just want to add my personal opinion. This is VERY disturbing. I agree, the person who conducts the interview should be able to send a petition back for further processing in the case of obvious fraud. But because he thinks a photo looks like a wedding ?!?!?! F'ing ridiculous and far outside the intent of the powers given to him/her.

Anyway, hang in there. I am sure you have followed similar cases here on VJ and they all seem to be resolved with some time. Good luck.

06/01/07 - Green card arrived in mail

Removing Conditions

03/02/09 - Mailed I-751 package (CSC)

03/06/09 - Check cashed

03/10/09 - Recieved Olga's NOA1

03/28/09 - Olga did biometrics

05/11/09 - Anya recieved NOA1 (took a call to USCIS to take care of it, oddly, they were helpful)

What on earth made the interviewer think it was a wedding?The obvious question that comes to mind here is did the interview have any understanding of your fiancee's culture at all????????? Hope you get this resolved soon because these sounds like utter nonsense!

Oh, and also -- isn't it well within people's rights to have a cultural/religious wedding ceremony abroad anyway, so long as they don't marry under civil laws? Even if it WAS a wedding celebration, that consular officer couldn't prove it was a civil wedding.

That is insane... which consulate did you go through? I am supposed to go to the Delhi Consulate on the 7th and am wondering what the heck lies ahead. Good luck to you... hope it all sorts itself out. (F)

July 3rd he flew to England to meet me

We fell in love while he drove all over the place coz I cannot read maps (we were supposed to go to Ingleton - but touched Darlington 4 times, Pierce Bridge 6 times, Scotch Corner twice and Bernard Castle twice and we never did make it to Ingleton)

It has been so long and so much has happened in between...

Arrived in Houston on October 29th 2006

Married 17th November 2006

Lost my father 8th January 2007 (all dates are a blur after this)

Conditional Green Card dated 24th October 2007

I-751 posted on 6th August 2009

Received on 7th August 2009 in VT

They dont have to prove anything. Based on the interview whether it seems unfair or not....it is well within the conof's rights to deny or request further evidence etc if the evidence provided (hard copy and verbal)does not seem plausible to them. It is up to the applicant to proove one has a bonafide relationship and that there is no intent to fraud. Sad as it is.....this seems to happen a bit when it comes to engagement parties being percieved as weddings.

It helps to keep the country/consulate in mind when answering these questions, folks. This objection is extremely common in India. Engagement and marriage ceremonies can be identical (or nearly) in appearance... I think there is one fire dance that makes one type of ceremony into a marriage. Or, as in other countries, the ceremony is virtually the same, but whether or not it's a marriage depends on what gov't registration the family does. Sometimes you can't tell from just photos.

Before saying 'oh, they have no right' or 'they are idiots', it helps to have some info about the specific location.

my fiance went through the chennai embassy and that consulate asked alot of questions to him. The people around interviewer told him that the red dupatta (veil) i was wearing its 'cuz of wedding. To hell with them! red dupatta i was wearing 'cuz i wanted to wear it, 'cuz i like it. i didn't know this would cause me this much trouble. I am very upset. :crying:

It sounds more and more ridiculous... a red duppatta signifies you are married??? What kind of people were advising the IO? Honestly Indians are very good at damaging the lives of other Indians... have seen it so often that it no longer surprises me... I am just sorry you have come across such people.

But don't they have the right to have a religious/cultural wedding abroad so long as they don't get married under a foreign country's civil law i.e. with a marriage certificate? Let me know if I'm wrong, but I was under that impression. Or do cultural weddings in India count as civil ceremonies?
