Is it possible to extend K-1 visa entry.

Timeline

My SO recived her K-1 visa in April and it expires in October.

When we filed last year I had returned to the U.S. and was to not to return to Brasil.

Since then I have returned to Brasil with my Job.

I work a 4 week rotation in Brasil 3 weeks Brasil 1 week U.S., thjis is the same schedule I was working when we met.

At this time it is not determined haw long I will be working in Brasil.

I can not expect her to go to the U.S. and me to be in Brasil.

Does anyone knopw if it is possible to file for an extesion, or do I just marry her here and start over again?

A K1-visa can't be extended (please anyone correct me if I'm wrong). You have two options. Either, you file for a second K1 along with a letter explaining the circumstances to USCIS or you get married in Brazil and eventually file for K3/CR-1.

After all of the problems and waiting for the visa, do you really want to start over? You should consult with your employer about your situation. Explain that after she arrives and you marry, that she will not be able to return to her country until she receives either her green card or advanced parole (travel document). The advanced parole will probably take as long as two months or longer.

Is this work schedule likely to continue for some time? Sounds like a difficult situation for a new marriage.

I've heard of reissuing a K1 visa that is still valid and unused. It would probably be worth your time to check on that possibility directly with the Consulate. Otherwise, you'll be starting over, in one way or another.

An accomodating employer would be the best possible option though. Barring the reissuance, I'd marry in Brazil and file just an I-130 when you're ready. Of course, you may still face changes in your employment requirements later. Tough situation.

I agree with pushbrk and Lal... Get intouch with the consulate.... They have the ability, the question is do they choose to exercise this ability.

PS

I think what you are referring to is the 90 day approved stay after entry (and therefore the occurence of the marriage) cannot be extended.

I think what you are referring to is the 90 day approved stay after entry (and therefore the occurence of the marriage) cannot be extended.

The visa can't be "extended" (either the six months to enter or the 90 days to marry) but it is "possible" to get an unused visa "reissued" by the Consulate during its initial six month period. It's a rare occurance mostly because it's a rare need. Only the Consulate can answer this. The kicker is the OP doesn't seem to have an ETA on when to reissue.
