My wife came to the US on a K-1.

We got married 2 weeks ago and now we are ready to start the Application to Register Permanent Residence or Adjust Status(I-485)

I have a quick question:

We downloaded all the forms, a total of 5 and since my wife is not planning to work any time soon, I was wondering if she really needs to complete the I-765. Also I understand that she will be able to work when she gets the permanent residency.

Now, she is not going to leave the country for a while, does she need to complete the I-131?

Nice to have a SS card for things other than just working . Also nice to be able to leave and return to the US if a emergency should occur back home.

Also no guarens on adjusting status in the near future and getting a GC. Some people are still waiting after a year!

As Fwaguy mentioned there is no added fee to file for either EAD or AP along with the AOS.

If your wife needs to travel she definitely needs to file for AP, it takes about 90 days for it to come in. She should not leave the country until she has it, and I see you mention for a while, keep in mind that she should always be ready to come back in because you don't know when the interview can be scheduled.

Also, the EAD has other advantages: it allows her to obtain a social security card is she doesn't already have one, most states also require at least that to give a DL. Not to mention that if she changes her mind and gets bored, at least she can work or study more easily.

My opinion is: since you never know how long the GC process will take you should file for EAD, especially if it's a not extra cost (unless you count the photos and the paper to print).

Apply for all 3 since it's included in the fee and always nice to have it just in case! It would suck to have to file an AP if you ever needed one last minute....

You don't HAVE TO file any of them, except I-485, to get residency. And you can get a SS card without the EAD. But like others have said, sometimes the wait is very long. There's a guy on the forum waiting for 3 years now. And situations change, she may need to travel suddenly. Or have to get a job if you lose yours, etc. Why not do it? Is it the extra paperwork? It's not that much more. I say file all 3 (485, 765, 131).

If my memory is correct, if you don't apply for a SS card within the 90 days of your arrival on a K3 (and actually even less) most SS office require either EAD or Green Card to issue a card. Check with your local social security office thoug.
