Hi all,

I know that K3 is a multiple entry visa, but can you leave the US to visit back in Canada after activating your K3, but before filing for AOS? I have just read this on the Q&A section of the US State Dept. Vancouver consulate website, and found this -

Can I travel and re-enter the U.S. on my K-3 or K-4 visa?

Aliens present in the United States in a K-3 or K-4 nonimmigrant visa status can travel outside of the United States and return using their K-3/K-4 visa. If they have filed for adjustment of status in the U.S. prior to departure from the U.S. , USCIS will not presume that the departure constitutes abandonment of an adjustment application.

So, my K3 appointment is in Vancouver on Thurs. and my husband and I plan on heading straight to the Peace Arch border crossing, activate my K3 visa and head to our new home together (hurray!! I can hardly wait!!), but I can only stay a week and then I need to return back to Canada for a few days for a family function. Will I be able to do that, if I haven't filed for AOS? Has anyone had experience travelling back and forth before filing for AOS?

Hi Annie, yes you can travel back to Canada and return. That is what it says. :thumbs:

YOu can go back and forth as often as you like while your visa is valid.

Keep in mind- once you have filed for AOS, you should no longer travel back and forth until you have your Greencard or AP. This is what was told to me by the officer at USCIS during my AOS interview.

I went back to Edmonton a few months ago (after my AOS interview)- on the way back to the US, I was pulled into secondary and asked about my situation. I told her I had my AOS interview and was approved but hadn't gotten the greencard in the mail yet. Still waiting, actually. She said ok and let me go.

K3 does not need AP. Ever. Not even after you've sent your AOS applicatoins. The K3 is valid 2 years for multiple entry REGARDLESS of AOS application.

If your K3 expires, you would be advised not to leave without AP, but for the duration of the 2 years, you can go back and forth as often as you like.

I was told differently by both the officer who interviewed me for AOS and the officer I just talked to when I went for an infopass appointment last week. The said once AOS is filed- you are technically no longer K3.

I don't know- all I know is I made my trip home and back. After a year- nothing was going to stop me from going home for a visit.

K1 is not a mulitiple entry visa... it is a one time use deal..

I've been travelling back and forth each week since I received my K3 visa, both before and after applying for AOS. I have not had any problems.

Some border guards like to us the US Visit procedure and fingerprint / photograph me, others don't seem to care. I do get a stamp in my passport now, that is about the only difference.

June 27th - scheduled biometrics, reschedule requested

July 14th - biometrics

July 16 - cases available online

Only with APPROVED Advance Parole or greencard
