HELLO. I HAVE BEEN RESEARCHING MY OPTIONS FOR A FEW WEEKS NOW. I AM HAPPY I FOUND THIS SITE. I SEE IN THE 129F PAPERWORK FOR A K3 A PART THAT HAS TO DO WITH CRIMINAL HISTORY. MY WIFE KNOWS EVERYTHING IN MY PAST SO THAT IS NOT A ISSUE. I STOPPED TAKING DRUGS AND FOUND GOD A FEW YEARS BACK AND I AM REFORMED NOW. I AM WONDERING IF IT IS GOING TO A PROBLEM IF I GO FOR A K3 OR IF CR1/IR1 IS MY ONLY OPTION.

HERE IT GOES

15 YEARS AGO MY WIFE CHEATED ON ME AND I SLAPPED HER. I WAS ARRESTED AND SENTENCED TO ANGER MANAGEMENT AND NO JAIL TIME.

7 YEARS AGO I WAS CHARGED WITH INJURY TO A CHILD. I WAS FINED AND NO JAIL TIME.

3 YEARS AGO I WAS DIVORCED AND HAD A RESTRAINING ORDER PUT IN PLACE AGAINST ME. I DID VIOLATE IT TWICE, NOTHING MAJOR JUST PHONE CALLS ABOUT THE SALE OF OUR HOUSE AND ABOUT WINTER CLOTHS. MY EX HAD ME ARRESTED FOR THAT LOL.

3 YEARS AGO DURING THE DIVORCE WHILE MY KIDS WAS VISITING ONE OF MY CHILDREN GOT A FAT LIP IN A ACCIDENT AND MY WONDERFULL EXWIFE CALLED THE POLICE AND I WAS CHARGE AGAIN WITH INJURY TO A CHILD, IT WAS PLEADED DOWN TO DISTURBING THE PEACE.

I WAS NEVER ARRESTED OR CONVICTED OF ANY DRUG RELATED CRIME.

THAT IS THE EXTENT OF MY CRIMINAL PAST.

WILL THIS HAVE ANY BEARING ON THE APPROVAL OF A 129F OR IS A 130 FOR A CR1 MY ONLY OPTION?

CHILDREN STAY AWAY FROM DRUGS, YOU DO STUPID THINGS WHILE UNDER THE INFLUENCE.

I AM VERY HAPPY I FOUND OUR LORD AND SAVIOR.

a big one , probably, if you had done it many times.. but if it is just once, then you can prove that you changed for the better.. Also, it is better to take more evidence during the interview later on..

THERE WAS 2 TIMES.

THE INJURY TO A CHILD WAS NOTHING MAJOR, I SPANKED MY 12 YEAR OLD WITH A BELT. I FOUND OUT THAT YOU CAN NOT USE ANYTHING BUT YOUR HAND TO PUNISH YOUR CHILD. A BELT, PADDLE, SWITCH OR ANYTHING ELSE YOU USE BESIDES YOU HAND IS CONSIDERED A WEAPON.

THE SECOND TIME MY YOUNGEST CHILD WAS BEHIND MY RECLINING CHAIR AND AS I WENT BACK HER HEAD GOT COUGHT BETWEEN THE CHAIR AND WALL. SHE GOT A FAT LIP. MY EX WIFE ACCUSED ME OF HITTING HER AND THE POLICE DID NOT BELEIVE ME OR THE KIDS THAT IT WAS A ACCIDENT, IT WAS PLEADED DOWN TO DISTURBING THE PEACE.

those two doesn't seem too major, so it's not that bad.. as long as it's not related to terrorists, drugs (trafficking), or other big stuff, it should be ok... but that's just my guess.. :whistle:

I believe that currently the USCIS is checking the US citizen spouse sponsor for any domestic abuse records, and that would include your restraining order. This may likely affect and slow down your sponsorship application.

divorced - April 2010 moved back to Ontario May 2010 and surrendered green card

What ever you do, disclose everything, cause when you make it to the Embassy interview, you dont want them to tell you that you left out a part or two. Tell them everything on your petition, its the best policy. Good luck on your journey.

Thanks for all the advice. Now if I dont file the 129f and just do the 130 form for the cr1/ir1 thingy is my back ground going to be a problem like it would with a k3? What kind of issues am I going to have? I for sure will tell them everything and wont hide anything. Its part of my recovery to meth,cocaine and heroin that I be open and discuss my past, it helps me deal with the past addictions and allows me to move foward. If i could take the last 20 years of my life back I would do it.

As I said the domestic violence happened a very long time ago. The no contact order was put in place by my ex wife as a way to get back at me. She was having another affair with this man from her work so I kicked her out of the house and I kept the kids. She signed a paper giving me custody of the kids then a few weeks after this she decided she wanted the kids but she had signed them over to me. So her friends advised her to lie and get a no contact order in place. She did just that and was able to play the emotional game with the courts and got the kids and the no contact order. It is no longer in place and everything is fine now. I have 50/50 legal and physical custody of the kids. I hope any of this will help. I love my kids and my wife and I hope that my past wont effect my future. I do not want to have to give up my children and move to Taiwan to be with my wife if I cant bring her here.

Can you tell me what is the Adam Walsh and how would this affect the I-130

On July 27, 2006, the Adam Walsh Child Protection and Safety Act (Adam Walsh Act), Pub. L. No. 109-248, became law. Section 402 of that Act amends INA 204(a)(1) and 101(a)(15)(K), rendering ineligible to file a petition for immigrant status under INA 203(a) (I-130 or I-600), or for nonimmigrant K status (I-129F), any petitioner who has been convicted of a "specified offense against a minor," defined in section 111 of the Adam Walsh Act as an offense involving any of the following:

A) An offense (unless committed by a parent or guardian) involving kidnapping.

B) An offense (unless committed by a parent or guardian) involving false imprisonment.

C) Solicitation to engage in sexual conduct.

D) Use in a sexual performance.

E) Solicitation to practice prostitution.

F) Video voyeurism as described in section 1801 of title 18, United States Code.

G) Possession, production, or distribution of child pornography.

H) Criminal sexual conduct involving a minor, or the use of the Internet to facilitate or attempt such conduct.

I) Any conduct that by its nature is a sex offense against a minor.
