Hi,

I came to US on k1 visa, got my AP and EAD documents last month. I have 2 questions

1) The reasons I gave while appliying for AP were in case of emergencies and to visit family in my home country. The AP document states "xxx allows me into the US based upon urgent humanitarian reasons or significant public benefit".

Can I not go out of US for any other reasons than mentioned above? We're planning to visit some countries for our honeymoon. Will I be allowed for that?

2) Since I got my EAD, I'm planning to take DL test. If I pass the test and get the DL later, how long will it be valid? I still have not got my conditional green card. I have my EAD valid for anohter year. Should I have to take another test after I get my conditonal green card/green card? Or can I renew it?

Depends on your state of residence... Some or maybe most will tie it to the expiration date of the docuement you provided as proof of legal residency. Typically it is renewable but you will need to show additional proof that extends your stay.

Depends on the state you are dealing with. I know that in Oklahoma, if you are K-1 and getting your DL based on the EAD card, the DL is only valid as long as the EAD card is valid. Consequently, once one gets their GC, they would have to go back to the DMV and get another DL. You will have to check with your local DMV office about their rules and regs.

If I take the test alone now and later when I get the AOS, can I take the DL ? That way, I need not take the test again when my EAD expires?

Depends on the state you are dealing with. I know that in Oklahoma, if you are K-1 and getting your DL based on the EAD card, the DL is only valid as long as the EAD card is valid. Consequently, once one gets their GC, they would have to go back to the DMV and get another DL. You will have to check with your local DMV office about their rules and regs.

I can't answer that, it depends on what your state requires.

Check with your local DMV. Usually you take the test, they give you a DL valid only for the lenght of your EAD and all you have to do when you get the GC is renew by paying the fees and getting a new pictures taken. At least that's with most states. I've never had to retake the test and I took it in 2005 when I was here on a J-1.

They know you can drive (once you pass the tests) the just care about the DL being valid when it should.
