Two questions regarding spousal visa

Hi, if anyone can either provide the info below (or tell me where I can check further) that will be very helpful!

As background, I'm a UK citizen, married to a USC (June 2000, in Pennsylvania, whilst I was working in the US on an H1-B visa).

We're currently resident in London, UK - my wife has indefinite leave to remain in the UK, but doesn't want to and we're therefore in the process of navigating the immigration route via the US Embassy in London. We've sent an initial batch of papers to the Embassy (I-130, 2 x G-325A and a bunch of other papers [ marriage certificates etc]) and had a form letter back as an acknowledgement (sometime last week).

My questions are:

1) Since I noted this morning that my credit card had been charged $355 by the Embassy, can I take this as a good sign that processing is underway?

2) The Embassy website currently says "As of July 14, 2008, we are processing petitions filed on May 2, 2008." - is this roughly 10 week lag normal and can I expect to now be waiting until mid-September for any further communication?

3) For my interview with the Embassy, I understand that I need to acquire a Police Certificate from the UK. I lived in Pennsylvania between 1997 and 2002. Am I correct in understanding from the London Embassy that I do NOT need a certificate from the PA police ("Present and former residents of the United States should NOT obtain any police certificates covering their residence in the U.S.").

All is looking normal to me. This topic will likely be moved to the DCF forum, since you did a "Direct Consular Filing" and not for a K3 but a CR1 visa. You will not need any police report from the USA. They'll just check the records directly.

Again, thanks for that ... however, I don't understand what you mean with reference to a K3 or CR1 visa. Please correct me since I'm probably wrong, but I thought the K3 was a spousal visa and a CR1 is "conditional residence", applicable if we've been married less than 2 years?

And as I read more, it appears that since we've been married for over 8 years, I'm eligible for an IR-1 (Immediate Relative) visa.

And I thought keeping up-to-date with advances in I.T. was tricky ... but the immigration twists and turns have that beaten by a mile!

Sorry, I missed the length of your marriage. Of course you would qualify for the IR1, not CR1. K3 is a spouse visa but not the path you're on. You're on the IR1 path. K3 is not available through a DCF filing and you really don't want it anyway.

No worries, Pushbrk, and I don't really mind which visa category I fall into ... so long as I get one

We've sold our property in the UK, for completion / closing at end of October - now, in view of the timescales being advertised on the London embassy website, we're busy investigating short-term options for accomodation until the process moves on later this year.

I note that IR-1 is an "Immediate Relative" visa - I now understand that the "Immediate" applies to the relative, not the visa -- oh well, patience!!

Again, my apologies if I am posting in the wrong place but I think (hope) I found an error slight mistake on the Direct Consular Filing page. Near the bottom of the page, under Typical DCF Procedure, Paragraph 5, the page says "The foreign spouse can not legally enter the US" - should that read "The foreign spouse can now legally enter the US"?

If the page is correct, then I'm still confused, but that doesn't take too much effort
