I-129F faster that I-130.?

Why would the I-129F be faster over the I-130..?

I-129F Fiancée visa - so he/she gets a visa and they come to the U.S. and then the marriage takes place..

I-130 - Marriage took place outside the U.S. and you want to bring your Husband / Wife home with you..

SO... If the USICS is worried about fake marriage why is it a shorter process to do the fiancée process vs. the "We are already married" I-130 process.

Myself, My wife and I met in Japan while I was working there, and we got married their over two years ago and now I moved back to the U.S., got a job and filed for the I-130 and have everything ready for the I-864 A.O.S. However after reading this forum, would it or why is it faster with the I-129F..?

On the down side of the I-129F visa... Is it true that once your spouse gets that visa (I-129F) that they can not leave the U.S. for about 2 years?

K3 visas are faster for some embassies not all. While the process at the USCIS is pretty much the same, some embassies will process K3 visas faster than CR1/IR1 visas. You will need to do more research on this and see if the US Embassy in Tokyo takes longer to process CR1/IR1 visas than K3. If not, then stay with your I-130 for the IR1 visa because if your wife comes to the US with a K3 visa, she will have to file for AOS which can take a minimum of 6 months to process and she will also have to get a work permit if she wants to work before her green card is approved. On top of that, you will have to pay an extra $1,010 for her AOS. If you stay with the I-130 alone, she will be given an IR1 visa since you've been married for more than 2 years and her 10 year green card will arrive in the mail a few weeks after she gets to the US.

But like I said, try to do more research on this because if the embassy in Tokyo takes forever and a day to process CR1/IR1 visas, then the K3 is the way to go.

One last thing, a K3 visa holder does not have to wait two years to leave and enter the US.

Your wife CAN leave the U.S. She needs to file for AOS and AP pnce she arrives to the states, she can travel to and from the states with the AP. then when she receives the green card she will not need to use the AP

Hi There, Why didn't you do Direct Consular Filing while you were there? Was not an option there in Japan?

That probably would have been faster for you.. I am not sure which is faster, I did the I-129F but I am still waiting on that :rofl:

But my I-130 got approved already in April... So who knows

I did not file while in Japan, because I knew I would need to file the I-864 Affidavit of support, so if I didn't have a job here in the US I could not show that I could support my wife. So I come here first, got a place to live, a good job, ect.. putting all our ducks in a row.

Then I filed the I-130

You can use a joint sponsor though. That is what my husband and I are doing. He is a USC who has been living overseas since 2004 (hence no US income). We are in Australia now and have filed for DCF through the Sydney consulate. His parents are acting as our joint sponsors
