HI I filed I130 for CR1 for my wife back on February, now i am thinking of filing I129F since i think it will speed the process of bringing her here so we can be together instead of us waiting for vermont to approve I130 and the additional time for NVC and consulate to process. But I am afraid if I filed I129F that the priority date will be affected? is that true? will the priority date of my I130 be moved so it can match priority date of I129F since both forms are processed together? please help me if you had the same experience?

You can just file I-129F without any issues... Also, no fee is needed if it is based on underlying I-130...

Even if you file an I-129F in Vermont for a K3 visa it does not mean they will speed up the process and approve both petitions. The only time when the I-129F makes a difference during a the spousal visa process is if appointments at a particular embassy will take less time than CR1 visas, for example like in the Dominican Republic. Otherwise, the time both petitions spend at the USCIS is pretty much the same.

although there has been a recent trend of simultaneous I-130 and I-129F approvals, filing for your I-129F would in no way delay your I-130. and it's true, getting a visa appointment is a lot faster for K3 and IR1. some may have to wait months before an interview is available for the IR-1 visa, whereas it'd only a few weeks for k3. not only that, NVC delivery to the embassy is pretty fast. mine only took a day in the NVC before it was forwarded to the US embassy. US embassy received it in a week. afterwards, you can immediately schedule your interview. if you take the fastest NVC route posted by lots of patience, u can cut down I-130 processing to 4 weeks. otherwise, it can take up to 3 months! Just curious,

If you file the I-130 then also send in the I-129F would not that take longer since the office would have to do more background check, more paper work and would it slow down the system for everyone?

I have been looking at the time line from the USICS website Processing Dates; and the I-130 and I-129F are about the same dates.. As of today 07/14/2008 the California service center are at December 2007 for both I-130 and I-129F

So if there were less forms for them (USICS) to go thru, wouldn't it go faster for everyone?

Maybe and that's pretty common when the I-129F is filed shortly after the I-130. (The actual priority date doesn't change but as a practical matter the cases are processed together based on when they were joined.)

However, it's been so long since you filed the I-130, they may not get joined before the I-130 is approved. In that case the I-129F would be denied anyway because there's no underlying pending I-130 anymore.

It's up to you but I wouldn't file an I-129F at this late date.

Facts are cheap...knowing how to use them is precious...

Actually, this trick MAY work... When you filed I-129F recently, USCIS has to look your I-130 file too to enter this I-129F, and WHO KNOWS you will get I-130 approval...

Actually, now-a-days, since random (no FIFO) approvals are coming, every piece of update in your record could trigger a look into your file and a potential approval... It could be I-129F filing, address change, senator request, false/true expedite etc... If it doesn't generate approval, you have nothing to lose too ;)

Yep, hiring a very good attorney and filing for an expedite (or doing it on your own if comfortable, but great attorney can help there a lot) might also be a great idea aside from filing I-129F. Otherwise, Vermont Service Center is going to process everything else before the family based petitions.

This sucks more than anything else has ever sucked before.

I'm also wondering about this...we filed in Oct last year and have had no sign of any movement on our case since 24th Feb when it was entered into the online system. We were one of those unfortunate couples who got caught up in the receipting backlog so we didn't get our NOA1 until January.

I keep thinking that despite this late date we should file for the K3 just to get the applications paired up and the I-130 would at least be noticed? Does anyone think this would work?

May be, yes, also write on a piece of paper about your I-130 pending and a request for the approval. Nothing hurts, other than extra postage...

i think you should do it because it has been a long time since no movement on your case maybe this will help to undust your petition and take a look on your dates and move you up :thumbs:

Well I'm in the same situation and my timeline is almost the same as yours. I was thinking to file I -129f as well, because it seems like VSC is apporving a lot of K-3 while there is absolutely no approvals for IR1/CR1 applications, besides those who filed expedite. So to say that K-3 and IR1/CR1 are taking the same time to be approved is NOT true at this time at VSC.

My wife talked to the immigration officer last week and he did suggest her to file I-129f, but I'm still hesitating, because as far as I know it will bring back the priority date of our application. So this late I don't

know if it's worth it to file I-129f.

If you guys think different please let me know and I might just go ahead and file it.
