6 months is the USCIS official processing times , USCIS will probably say "be patient and wait" if you call at this point. Call closer to the 6 month mark, but of course you can have the Petitioner call for peace of mind if it helps.

Because two couples have the same timeline does not mean their case will be adjuticated at the same time. That's just not how it works. If there are others near your NOA1 date here on VJ still waiting then they probably just haven't got to your box yet.

And, I agree with Nico, the uscis will give you their standard response that you are within their posted processing times.

Yup sorry to say but even though I filed at CSC I am sure the cases are handled the same way....some adjuicators are faster than others at doing approvals....my case is unfortunatley sat upon someone's desk who does not work very fast.....so we reach 6 months this week since we filed :( When I called most recently they told me just that "Some workers are faster than others" ughhhhhhhhhh frustrating but nothing I can do....

I know it is the hardest thing in the world to be patient but that is only thing you can do....

Good luck!

A denial will take the same time as an approval. Don't read anything into the length of time it is taking other than that they are backlogged.

So, denial can happen in USCIS as opposed to the other reply earlier???

Yes, denial can and does happen at USCIS. There have been posts here on VJ of petition denials. In the cases of denial, either they were not eligible to submit the petition or they did not supply some critical document or did not respond adequately to an RFE.

Some reasons for denial:

1. Not legally able to marry at the time the petition was submitted. There have been some to submit the application before a final decree of divorce or before a statutory waiting period has been satisfied.

2. Permanent resident filing petition only allowed for USCs

3. Filing a second K1 within 2 years or more than 2 without an IMBRA waiver request.

4. Not meeting in person within the past 2 years.

The reasons for denial are not arbitrary. If you meet the requirements, you will be approved. It's just a matter of waiting.

We don't belong to the 4 reasons mentioned above except that I was previously petitioned for K1 visa a year ago. My ex-fiance got married already and "petitioned"(term???) another girl who got an expired working visa in the US.

My question is will my present fiance's petition be denied because he is petitioning a girl who has been petitioned under K1 a year ago???

We have different experiences on this k-1 process. You happend to be in a long wait category so add another 100% of your patience to make it 200% and everything will be fine. Only the us embassy could decide wether your case is approved or denied but since your case is still in the uscis hand no denial will gonna happend then they will just let you know if they need some more docs from you. Be positive!

HALLER!

My question is will my present fiance's petition be denied because he is petitioning a girl who has been petitioned under K1 a year ago??? [/color]

The petition will not be denied for that reason.

You may, however, encounter some extra scrutiny at the consulate because of the recent K1 from a different petitioner.

Just be patient. Waiting is tough, but virtually no one on the initial K1 petition gets denied at the Service Centers. We waited 241 days, close to 8 months. Your time frame should be quicker, but who knows. Good luck.

We were expecting last month since he filed in VSC and now it's the fourth month and still no NOA2. huhuhu! Thanks anyways..

nah.. be still gurl..:D we had ours for 5 months..:D check out other time lines so you will know..:D Good Luck!

So girl..just relax..dont think it everyday..remember..ang wrinkles...LOL :star:
