Timeline
How do we know if the petition is being disapproved or denied? Does a long wait means disapproval? Please enlighten us as we are stressed already for the long wait. Thanks folks.

Just be patient. Waiting is tough, but virtually no one on the initial K1 petition gets denied at the Service Centers. We waited 241 days, close to 8 months. Your time frame should be quicker, but who knows. Good luck.

We were expecting last month since he filed in VSC and now it's the fourth month and still no NOA2. huhuhu! Thanks anyways..

If you lower your expectations the chances of being disappointed are greatly reduced

We were approved in 3 months from VSC...others have waited 7 or 8...it's a guessing game really.

Don't stress over it....compared to the rest of your lives this time is relatively short. Even after NOA2, you still have some more waiting to do, more paperwork, etc. etc.

Have faith in your love and take each day as it comes.

Timeline

It is not common to have a petition denied at the uscis level unless there are circumstances such as one of you is not free to marry and/or IMBRA related issues...etc.

All that you're really providing them with at this stage is that you are able to petition someone from another Country and that you have met in the last two years. There are database and security checks and things like that that can slow you down.

The Consulate level is a different story. Higher fraud Consulates, of course, see higher rates of denial and some are just more difficult to deal with.

You have waited longer than some but are still well within the VSC adjutication dates. I wouldn't worry too much about denial at this point unless you have good reason to.

Yes, denial can and does happen at USCIS. There have been posts here on VJ of petition denials. In the cases of denial, either they were not eligible to submit the petition or they did not supply some critical document or did not respond adequately to an RFE.

Some reasons for denial:

1. Not legally able to marry at the time the petition was submitted. There have been some to submit the application before a final decree of divorce or before a statutory waiting period has been satisfied.

2. Permanent resident filing petition only allowed for USCs

3. Filing a second K1 within 2 years or more than 2 without an IMBRA waiver request.

4. Not meeting in person within the past 2 years.

The reasons for denial are not arbitrary. If you meet the requirements, you will be approved. It's just a matter of waiting.
