Thanks for your reply. I dont know how to i check the I-130. I came on H1B visa on December 2002 and before the expiry of H1 I married and applied for the change of status. I have only two application numbers 1. I-765 2. I-485

Many of us can relate to your frustration Rasheed. you have been waiting VERY long so LaL does have a good point about visiting the office. Maybe with the memo in hand they will actually push for someone to look at your case. On the other hand, wait to see what the Ombudsman says if you don't want to drive to Georgia.

Best of luck. I'm also married to a Pakistani and we've been waiting a while too.

Has your I-130 been approved already?

Is this is the correct address of Ombudsman? This is the address where i sent my request by mail. Also do they have any fax number?

Well, it must be a hard situation .Of course, according to the law , you cannot apply for citizenship, unless you already have thegreen card .but if none of the procedures work ( calling the immigration services , an infopass appointment, getting intouch with the congressman or senator ), it 's time to consider an immigration lawyer- an attorney specialized in immigration cases, not anylawyer-at least for an initial consultation , the fees are generally between $50 to $100 for an initial consultation as I read in a law book.you don't have to have a lawyer , but an initial conversation from an experienced immigration lawyer can give you some guidelines you can flow yourself . you need also to keep praying for God to help you out of the situation, and good luck

Thanks guys for prompt replies. I just sent fax my problem at number (202) 272-1865. I dont know my phone will be ring or not but trying and follow any thing which is in my control.

Hi guys: If i try to do a lawsuit against USCIS. What i have to do for that. I can prepare the lawsuit in microsoft word then what i have to do? Honestly no money in pocket to pay the bills of lawyer ANY IDEA

Hi Guys: I filed my I-485 in june 2005 on marriage basis as my wife is US citizen and since to date its been hold because of name check. I got my first EAD on time but the second one they give me after a very hard time and wait for atleast 10 months to get that. My second EAD will be expire at the end of october 2008 and I already applied for the third one. Can any one please tell me that why the immigration give me that much hard time? Also in 2005 when i got my first EAD they also sent me a letter for the interview which was just after 90 days but without telling any reason they cancel my interview and since to date i never been interviewed at USCIS.

The FBI is the first to admit that it can't handle the rush of name checks now required by law. They say they just don't have the staff to keep up with the new workflow. That's of little comfort to you. The politicians will say there is no money to hire enough new staff for the FBI, because of all we are spending in Iraq and Afghanistan. The bottom line is that you will just need to keep getting EADs until the mess clears up. There is really no one to contact...as it is all in the FBI's hands and they will not answer any questions.

You may want to consider filing a writ of mandamus to facilitate your case. I have read of several people who have done so and had their application approved alomost immediately

The new ruling to expedite the processing of backlogged name check cases was due to these lawsuits that applicants were filing to expedite their pending name checks. To alleviate this, USCIS now approved your application conditionally pending the name check. The link above tells how you how to go about filing the writ or you can get an attorney to do it for you.

The loophole that got closed was for the citizenship applications. I believe you can still get some results from filing pro se or hire a lawyer. The court does not have jurisdiction over the case but they can order the INS to either adjudicate the application or state specific reason otherwise. Atleast you would get some answers for your case. I am planning to do the same thing. I have talked to five immigration attorneys including an ACLU lawyer.

Thanks Shakil. I dont have money to hire the lawyer but I would be very thankfull to you if you please send me the paper work in which i have to change my personal information and then submit to the district court. Also if you please tell me the step by step instruction it will also help.

I am going to choose a lawyer and file the case. I will, I believe, get the documentation and I will forward it to you. I am also waiting for the Ombudsman to respond. If I don't get anything from him then I would have to go for it.
