Hi Guys: I filed my I-485 in june 2005 on marriage basis as my wife is US citizen and since to date its been hold because of name check. I got my first EAD on time but the second one they give me after a very hard time and wait for atleast 10 months to get that. My second EAD will be expire at the end of october 2008 and I already applied for the third one. Can any one please tell me that why the immigration give me that much hard time? Also in 2005 when i got my first EAD they also sent me a letter for the interview which was just after 90 days but without telling any reason they cancel my interview and since to date i never been interviewed at USCIS.

I dont know why they are giving you a hard time, Maybe it is because your from Pakastain.

If you been married for 3 years, I would skip that AOS and just file to become a USC.

Thanks guys. Yes i did an appointment just a month ago and they told me that the application is on hold because of my name check. Also can you please tell me which form i fill to apply for the citizen ship. I dont know that i can apply directly even i didnt get my GC?

You can't apply directly for citizenship, I think he/she's just yanking your chain.

Can any one please suggest me what i do now. I already knock the doors of congress members, senators. Only thank you letters nothing any action.

I guess you should start writing to congressmen and senator in your area. Also try contacting Ombudsman. I am from Pakistan too, my AOS has been put on hold since Feb 07 right after my interview. My namecheck was cleared and there was no problems over there.

According to the new rule:

USCIS cannot hold your application due to name check backlog or if it is not cleared.

USCIS website says:

I-485:

Q3. How has USCIS changed its adjudications requirements?

A3. For these forms, including applications for lawful permanent residence, USCIS will adjudicate the application based on all required evidence outlined in applicable law and regulation if the application is otherwise approvable, outside of normal processing times, and the FBI name check request has been pending for more than 180 days.

In the unlikely event that Department of Homeland Security, (DHS) receives actionable adverse information from the FBI name check after the application is adjudicated, DHS may detain the applicant and initiate removal proceedings.

For pending applications outside of normal processing times, we recommend that customers wait until March 10, 2008, before inquiring about cases affected by this policy modification. This will allow each office sufficient time to identify and adjudicate the relevant pending cases. If no action is taken by mid-March, we recommend inquiring with the USCIS customer service line at 1-800-375-5283. This procedure is for customers who have been previously informed that their case is pending due to the FBI name check. (Cases that are still pending within the processing times will be completed when the related adjudication actions are completed.)

Search for USCIS Ombudsman on google. On his website you are going to find a form that you can fill out and mail it to him.

We went through the same wait for AOS we didnt have any prob with EAD or Travel Doc.

Just had our AOS interview in Oct 2007 and got GC in June 2008

After all this waiting and they still sent a conditional card so now we are in process of getting it corrected.

We filed AOS in July 2004. It will workout but its nerve wrecking.

They are only now clearing the backlog of applications. In other words - the date this policy is to be in full effect in Feb 2009.

My suggestion would be to go to another infopass appointment. You can bring with you the memo that outlines the clearing of the backlog benchmarks. Check out THIS link and read the related pdf.

Thanks. I again wrote the letter to congress member, senator and also to Ombudsman. But I dont want to go again to immigration office. I am tired to run for that. I live in Alabama and the office is in Georgia. Again burn $100 gas for nothing accept in the line then listen same bulshit. Bettter wait what they will do. I already applied for the third EAD, accept that I have the problem with the driving license I dont have any other problem to live. I am happy with my wife and we dont have any problem. Just want to see what they will do with me. Over 3 years is enough time listening their bulshit same letter from immigration to wait for another 6 month atleast 6/7 times in over 3 years. I also received the same letter to wait for another 6 month

Many of us can relate to your frustration Rasheed. you have been waiting VERY long so LaL does have a good point about visiting the office. Maybe with the memo in hand they will actually push for someone to look at your case. On the other hand, wait to see what the Ombudsman says if you don't want to drive to Georgia.

Best of luck. I'm also married to a Pakistani and we've been waiting a while too.

Temporary EAD given for 1 month ONLY b/c of Infopass appt: 5/1/2006

Went back to renew EAD through Infopass: EAD card was not given "due to reasons we can't disclose"

5/3/2007: Confirmation that EAD is delayed due to background checks. (started to use the senator, ombudsman and was just a royal pain in the neck)

5/30/2007: EAD production ordered (after over 400 days of waiting!!! woo hoo!)

AOS Interview: 5/12/2008!!! FINALLLYYYYYYYYYYYYYYYYYYY!!!!!!!!!!!!!!!!!!!!!!

7/29/2008: card production ordered...918 days..can't wait to see that card!
