filed my second i-130 in july 7th and it was recieved in chicago at the 10th .this is the second i-130 i file for my husband, i file the first one in jan-07 and was denied at the local office in oct-07 for lack of evidence and because my first attorney screwed up the whole thing by not sending our divorced papers and the g-325a etc... i appealed it in oct 2007 and havn't heard anything ever since soi just filed the new one with much better evidence this time and i hope they will approve it this time, but one thing i need to know about guys , i didn't withdraw the appeal for the first one, is it ok to have an appeal pending with the new i-130 or i have the withdraw it?

1. Why didn't you just send them the additional evidence (divorce papers) they needed the first time?

2. Did you acknowledge that you had sent in a previous petition in your 2nd petition?

30th April 08 - USCIS returned petitions requesting correct title on cheques

2nd May 08 - Mailed out I-130s again! Finally on our way!!!

9th May 08 - NOA-1

7th Nov 08 - Tranferred to CSC

4th Dec 08 - Approved!!!

22nd Dec 08 - NVC # assigned

23rd June 09 - Case Complete at NVC (We slowed down the process on purpose to time interview accordingly)

18th August 09 - Medical

25th August 09 - Interview Date - Approved!!!

19th February 10 - POE L.A (No dramas, just SLOW)

2nd March 10 - Welcome to America Letter

1-we did but they they said it was too late and we can't send them on 2 or 3 times so they deny it

Are you sure it is the reason why they denied your case? Perhaps, it is because of evidences?? I was just wondering why they have denied it instead of asking you for additional evidences (RFE)? :unsure: We have sufficient evidences (more than enough as you could say). :P You could file for I-129f after NOA1 for free but in our case, my husband paid for both (I-130 and I-129f). We also have a lawyer but I am making it sure that we have a hold of all the things (meaning I need to know what was happening and that I am aware of everything)..

I-129f for spouse is K3 not K1 (K1 is for fiance). Both CR1 (immigrant) and K3 (non-immigrant) are spousal visa. I have read and researched as well so I knew what is going on(making sure that the lawyer won't mess up). I am aware of all the papers needed to be submitted in the application. In your case the lawyer screwed up by not sending the requirements especially G325-A and divorced decree (we are both single so we don't have such) which are of high importance in connection with the application. VJ forums would be a big help not just to you but for all of us..

exactly, e=that exactly what happened, he sent the form with no 5-325a etc... nothing but the form and they thought that we were trying to lie and het k-1 and cr-1 at the same time because there was no i-130 receip sent with it as well , and he didn't send all the evidence we gaved him so they deny it after 10 months at the local office :( but i sent everything in one time now and i sent alot more evidence but i am afraid they will send it to the local office again , and also i am just waiting for my receipt so i can request to expedite it because i need few surgerys in my lower back and my neck very soon and also i have a heart setuation and i can not do this anymore without him. so hopefully they will approve it this time and iwill be sending the i-129f as soon as i recieve the i-130 receipt ,but hopefully that pending appeal wont screw things up

I am just curious, if what I have read so far about k-3 process I think i-129f is free even if you have filed it prior to getting NOA-1, I guess you just need to keep an extra copy of the fee you filed for i-130.

As you said prior to NOA1. In our case, we filed and sent both I-130 and I-129f (we never even have receipts yet) so we need to pay for both. My husband prepared two checks for USCIS and sent it together with the application. I told him that we better send I-130 first so that I-129f would be free but he is such in a hurry. Anyway, perhaps USCIS would refund the money or never encash the check if it is not needed?? :P

Our papers were sent July 3 but due to July 4th holiday, papers were delivered in Chicago Lockbox on the 7th. It was just like 7 working days so I am not too worried about it. Did you ever receive yours?
