In 2005 I traveled to the US I am a UK citizen, I stayed in New York with family for three months and then moved to Florida.I extended my visa and was staying with family again.My fiance and I met in March 2006 and were in sepreble from then on.I lived with my cousin but stayed with my fiance more often then not.He even put me on the lease to the apartment as it was a gated community to be honest we rarely spent a night apart ,but I kept my place with my cousin and always extended my visas from his address. I have always had my own income as I rented my house in London.In march 2008 my latest extention was denied and stupidly I left returning to England, truly unaware that I had just deported my self.When I tried to return to the states in April I was denied entry based on that I was not eligible for the VWP.I then returned to London and made an appointment with the US embassy,the earliest appointment was July 9th where they refused my application due to not being in my own country long enough but did not excude me from re-applying.We are now about to send in the K1 visa as all we want to be is together we have phone records, pictures, lease from the apartment,records of my extentions. I suppose what I am asking do we tick the right boxes,I am so nervous that we will never be together again.Please give some advise

Hi, Being denied for a tourist visa does not prohibit you from receiving a 'k" visa. we were denied a tourist visa May 2007 and we have our interview July 17th. we had to mark the box "yes" that said have you ever been denied a visa previously. Also it was explained to me by my attorney that the people that deal with tourist visas are much different than the consular officers that handle "k" visas. they are more educated and have not been told necessarily that "everyone intends to illegally emigrate"

my point is they are 2 different creatures, tourist visa versus K visa. stop stressing you will go bald or Grey!!! trust me on the grey part.

Hang in there puppies. I am sure that everything will work out fine for you both. But, you need to prepare yourself for the long haul. It will take quite some time for you to get to the US with the K visa. Work on being patient. The good thing is that you already have established a good history of your relationship. Have your fiance file the K1 ASAP.

Rebecca, I don't think she meant 'deported' in the sense that we might read it. It's a strong word... must be careful in how we use it. ;)

Gemmie, she was here on a visitor's visa. She extended that visa a couple times. Even with the VWP you need to be spending more time in your own Country than you are in the US and will be "denied" entry if the POE thinks you may have intent. Ask me how I know. :whistle:

OP... I'm pretty sure if you were turned away at the border you were 'allowed to withdraw' your attempt to enter. It should have no affect on your K1. It will be a long haul, though. So put on your patience hat! Good luck.

Right. Terminology is everything.

But - what was in the passport? That's the key here. Not many from the UK can stay as long as posted even with a visa....

I seem to recall one of my colleagues saying he had an extension on his VWP entry when visiting the USA ( but this was some time ago) -

As nearly as I am aware, VWP entrants can't extend their stay. Here is a good link from CBP which gives an overview of the program.

I'm thinking the OP was admitted by another method than the VWP. If not, there is an overstay involved. Which is why I ask about what might be in the passport.

What do you mean - 'deported yourself'?

Why did the officers deny your last entry? Did they stamp your passport? If so what does it say?

I literally got 5 extentions over 3 years I tried to return 2 weeks later and was denied on the vwp

Why did you need a visa if you're from the UK? Or did you stay there for an extended period? Sorry if I've misread/not understood.

I entered in 2005 on an indefinet visa issued in 1979 which was canceled on entry in 2005

OK, I've not heard of an indefinate visa but then I never professed to know everything.

Do you mean a visa that allowed you to stay here indefininately? Or a visa that allowed you to enter as often as you wished (multiple entry)? This visa probably had a name or number. Do you know what it was?

Did you have an I94 in your passport from that 2005 entry? If so what was the date on it?
