1-751 GC expired

Hi

My wife's GC expired,and we got a biometric appt slated for next week. What happens now that the GC is expired. In other words the status is not clear. Is there any precautions to take while at the biometric appt? Who has had a similar situation and how did it go?

This happened for us too. We never got a NOA and my wife wanted to go home for a visit. So we made an infopass appointment and got a 1 year extension stamp in her passport. The guy at the infopass appt said we should have got a NOA. Duh! She traveled with the stamp.

By filing the I-751 your wife's conditional green card status is extended whether she received the NOA notification or not. If she didn't get the NOA, she can get 'proof' of her status by making an INFOPASS appointment at your local USCIS. She brings her expired green card and her unexpired passport and they will put an I-551 stamp in her passport that should be good for a year. If she did get the NOA extension letter, she carries that (or a copy of that) with her expired green card. The NOA letter is proof that her conditional green card status is still valid as it has been extended for a year.

There are no 'precautions' to take at the biometrics appointment. She will be fine. Bring the items they request in the letter and remember that she will probably have to leave her purse and cell phone and everything except those items in the car for security reasons. When she goes in for her biometrics she will show her letter and her green card and her passport/identification to the security guard. He will give her a form to fill out (make sure she has her Social Security Number with her as it is asked for on the form). She will then stand in line for the next available 'clerk' (don't know their title). They check over the forms and make sure everything matches, then will give her a number. She will sit in the waiting area until her number is called, then she will have her fingerprints taken digitally and her photograph taken. Once they are satisfied with the fingerprints she will be done and can leave. Generally it should take no more than 20 minutes to half an hour unless there is a very long line up of other people waiting for biometrics.

She can use the number on her biometrics letter to check the status of her application on line at the www.uscis.gov site.

Biometrics are painless and very straightforward as is getting the I-551 stamp in the passport at USCIS. Don't worry - everything will be fine.

Today we got an extension letter for 1 year. At least it cools down our anxiety about the expired GC. Each letter we've recieved from USCIS has a completely different reciept number. ( On the check was different number,biometric letter different number, now the extension NOA1 a different number...is that common?

Secondly, Is it neccessary that this extension be stamped in my Wife's PP? If so, do we have to make an infopass or just request for it when she goes in for the biometric appt this Thursday?

Congratulations on getting the NOA1! Usually the number on the NOA1 and the cheque are the same and the number on the biometric letter is different. You could try entering all 3 numbers on the USCIS case status update form and see what happens. Only the biometrics letter number should work, but you never know:-).

Now that you have the NOA1 it is unlikely that they will give you an extension stamp. Usually you have one or the other, seldom both, unless you have a good argument that the country you are traveling to will have difficulty accepting the extension letter upon a return flight. You can't get the stamp at the biometrics appointment - they are handled through different departments. If you think you will have trouble on the return flight with the NOA letter you could still try for the stamp. It would require an INFOPASS appointment. You do need to realize that they may well say no now that you have the NOA1. THe NOA1 extension letter and the expired greencard should be all you need.
