Well,

Today was one of those days. Being a reservist I made the priviledge of attending a dedication for a fallen comrade of ours. Our congressman attended. I had no thought to inquiry about my situation with my Nadya's K-1. As luck would have it after we left and attended a lunch. One of my friends ran into a old neighbor. This neighbor is currently working as an aide to the congressman. I was introduced and brought up the issue of the K-1. He told me to go to the local office and get hold of another aide who works on these kinds of cases. So I went later and was surprised to find out some things. I mentioned everything about our case to him. I figured I give him the imformation and he call me later. But he said to sit down if I have time and he would call them right now. My heart leap!! I told him that the USCIS was shrouded in so much secrecy and that help lines were very limited in telling us anything. He said that was true but not so for members of congress. Well he got a LIVE person and that person told him everything that he currently knew about my case. I am current being investigated by the internel investigation ICE unit within the Regional USCIS. They report directly to Washington DC. No FBI thing, as was originally notified to me by mail. The aide did ask if there was anything they can do to get this thing expedited. (being a military member)Of course the answer was no. They could not tell how long this would be. But they did tell the congressional aide to write to the US Customs in Washington because that is where the final determination is made about "name hits". He told me[the aide] that a letter will go out to them immediately. I should find out more soon (2-3 weeks). Listen up people. My case is complex and I did not get all the answers I wanted. But it does make me good to know there is a way to crack this wall the USCIS has built around itself. We may get letters telling us to wait. Well I not waiting for someone to decide my life. Either should anyone who has had to wait too long. Does not matter if USCIS are slow or you are being investigated. There is defintiely something refreshing to see when you get a glimps of the darkness that surrounds the USCIS. So use our elected officials. I am still having to wait. But I know they will not forget about my case as long as I yell loud enough.

03/28/09 - Olga did biometrics

05/11/09 - Anya recieved NOA1 (took a call to USCIS to take care of it, oddly, they were helpful)

Yes they touched the case on the 28th of FEB.

Ok thanks for sharing your story. My case is past the processing dates, but has not past the 30 day 'requirement' for them to investigate. I fell I will have a similar situation to yours, however, my case has not been touched so it is possible it was lost as well.

So, thanks again for the info. I will definitly use my congressman when the time comes.

Did they notify you by mail that there was a “name hit”?

Yes, they did. They sent me a letter saying the I am under an FBI investigation and to not call them for 6 months. if they think I am going to wait. They got the wrong fool.

After last week's "inactivity" out of NSC, I contacted my senator and congressman - just a little inquiry at this time about generally what is happening to the process. I received a "we will look at your message when we have time" response from the senator and nothing at all from the congressman. It appears that I will need to get more serious responses and support from them eventually, but for now I am simply beginning the discourse.

I certainly hope that your contacts help get your case off the dime and moving forward! I was crushed to read about the six (6) month delay to investigate, because I know that is what will happen in my case. And, I do not understand the arbitrary time that is (IMO not!) necessary to set it aside for six months -- it doesn't take that long to gather public records or request and receive more information from a petitioner!

When we were waiting for our noa2(which by the way was 30 days outside processing times) I called my congressman. He called for me & he was told that our case was "under review". I rec'd a letter a few days later telling me that it could take 6 months to process our case. We rec'd our noa2 within a month of that letter.

There are many people who recommend calling a local representative & then there are those that feel it could bring a little too much attention to a case. I am glad that I called, it did make me feel better, but in our case, I really don't think it made one bit of difference.

I guess I am just getting used to the delay. Of course I do not give am damn if I bring any attention to me or my case. The way I see it they have to make some kind of decision. Deny or approve the visa! I just not going to go for this delay thing anymore than I have too. I am a US citizen and I meet the basic requirement as forth in their regulations. I am not some radical just a hardworking guy who found my love. But if they decide shelf this thing because some things need to be "Resolved" before it moves on. Well that's the part they seem to use to delay a visa. I will let the congressman's office handle it for a few weeks. Then I go to plan B. Trust me I am trying to figure just what that may be. I really appreciate your kind words. Thank you

Here is the response that I received from my congressman, today:

"Thank you for sharing with me your thoughts regarding immigration issues.

The legislation to which you referred, the International Marriage Broker Regulation Act of 2005, was not considered in the House of Representatives as a stand-alone bill. Instead, it was included in a much larger bill, the Violence Against Women and Department of Justice Reauthorization Act of 2005, which was approved by the House by a vote of 415-4 on September 28, 2005, and was signed into law on January 5, 2006.

Per your request, I contacted officials at the U.S. Citizenship and Immigration Services (USCIS) service center in Lincoln, Nebraska. The Nebraska service center accepts and processes the applications and petitions from people residing in Minnesota, as well as Alaska, Colorado, Idaho, Illinois, Indiana, Iowa, Kansas, Michigan, Missouri, Montana, Nebraska, North Dakota, Ohio, Oregon, South Dakota, Utah, Washington, Wisconsin and Wyoming.

According to USCIS officials, there has been a slow down in operations at the Nebraska regional service center because of an ongoing reorganization of USCIS field offices. Currently, the USCIS four regional service centers, as the name suggests, process visas and petitions filed in the states within each of the centers’ assigned region. USCIS is restructuring its regional service centers so that each center specializes in certain types of visas and petitions. For example, the Nebraska center processes petitions for alien workers filed across the nation, rather than just in its own service region.

Unfortunately, while USCIS continues its restructuring efforts, we can expect to see more delays. USCIS officials are hopeful that once the reorganization is completed, the service centers will be able to process visas and petitions more quickly and efficiently.

Rest assured that I will continue to monitor the situation."

So far I see no action out of Nebraska since May 4th....

Well this looks like a HUGE reorganization and this will cause a ripple effect all through the visa process. Not to mention this pretty much confirms what we have been seeing lately. Fasten your seatbelts. it's going to be a bumpy ride. Then again, I am under a ICE security investigation so I am not even part of the normal process anymore. Jeez this keeps getting better and better.
