FILING WHILE OUT OF THE COUNTRY ON MY 90 DAY

HELLO TO EVERYONE,

MY THREE YEARS AS A SPOUSE TO A USC WILL BE ON APRIL 26, 2009.

TO COUNT FOR 90 DAYS BEFORE,IT WILL BE JAN. 25,2009.AM I CORRECT?

NOW MY OTHER QUESTION IS THIS;I WILL BE OUT OF THE COUNTRY ON

DECEMBER TO MARCH TO ATTEND AN IMPORTANT FAMILY MATTER,

SINCE JANUARY 25TH IS MY FILING TIME,CAN I LET MY SON WHO WILL BE STAYING

HERE TO MAIL MY PREPARED ENVELOPE? I AM WORRIED THE FACT THAT COME

THE DATE OF INTERVIEW,MY OUT OF THE COUNTRY ON THIS 90 DAY PERIOD

MIGHT AFFECT MY APPLICATION.

WHAT ARE YOUR THOUGHTS ON THIS? PLEASE I NEED FEEDBACKS AS I

HAVE TROUBLE POSTPONING THIS TRIP, AND MY FILING DATE ALSO WORRIED ME.

THANKS FOR ANY ENLIGHTENMENT.

I personally don't see a problem with it. This is just my opinion and I could possible be wrong.... Hopefully someone else here who has done that will help you! Good Luck!!! :thumbs:

Keep in mind that things can happen rather fast. I mailed off my application May 30 and had my biometrics first scheduled for June 26, which I had to reschedule.

One doesn't have to file for naturalization within that 90 day period. I could have applied way back in Sep 2007, but was in no hurry, thus I applied May 2008

Canadians Visiting the USA while undergoing the visa process, my free advice:

1) Always tell the TRUTH. never lie to the POE officer

2) Be confident in ur replies

3) keep ur response short and to the point, don't tell ur life story!!

4) look the POE officer in the eye when speaking to them. They are looking for people lieing and have been trained to find them!

5) Pack light! No job resumes with you

6) Bring ties to Canada (letter from employer when ur expected back at work, lease, etc etc)

7) Always be polite, being rude isn't going to get ya anywhere, and could make things worse!!

8) Have a plan in case u do get denied (be polite) It wont harm ur visa application if ur denied,that is if ur polite and didn't lie! Refer to #1

I agree with flames - the window for filing opens 90 days before your third anniversary of permanent residency but you do not have to file then. In fact you can wait as long as you like, or never file if you don't want to. I would recommend filing when you come back from your trip as one of the questions on the application is regarding trips out of the country. Since you won't be here you cannot answer it truthfully with regard to the return date. (you don't know if you will be delayed for some reason).

June 13 applied for SSN

June 30 Wedding on beach at sunset awwwww

July 11 Sent off AOS/AP/EAD to Chicago

Sep 1 I485 transferred to CSC

Sep 15 EAD and AP approved (59 days)

Nov 25 Green card and Welcome letter arrive in mail (no interview) 130 days

Removing Conditions 2007

Aug 15 I-751 sent to Nebraska

Sep 14 NOA1 rec'd, transferred to CSC again

Sep 21 rec'd bios appt for 9/28/07

Jan 26 2008 Approved. 10 Yr card received 1/28/08.

Naturalization 2008

Sep 8 N-400 sent to Nebraska

Sep 11 Priority date

Oct 7 Biometrics

July 10 2009 - Interview, approved!

Aug 20 Oath ceremony

WOULD LIKE TO FILE ON THIS 90 DAY SO I'M DONE WITH THE INS PAPERWORKS ,

BUT IF THIS WILL RAISE AN ISSUE ON MY BEING OUT OF THE COUNTRY,

I MIGHT JUST FILE WHEN I'M BACK. I THOUGHT IT'S REALLY NECESSARY TO FOLLOW

THIS 90 DAY TIME TO FILE.

No for naturalization you do NOT have to file with in the 90 days. One Doesn't even have to become a USA citizen. And please loose the all capitals, makes it hard to read. Enjoy ur trip
