Hello fellow visa journeyers!

I'm looking for some advice on whether or not my husband should apply for advance parole. We sent all the AOS paperwork in February and received his EAD a few weeks ago. I just realized that we could have sent in the AP with the AOS. It's funny how you do so much research and think you have everything just right...and then you forget something!!

Anyways, our case has been transfered to CSC. Should we go ahead and apply for the AP since technically it's already paid for? Or do you think the green card will come before we even get the AP?

Any advice or thoughts is appreciated!!

Good luck to all that are still waiting! :star:

You may wish to check and see if there is still no additional fee if it isn't submitted concurrently with the I-485. I don't know if it is or isn't, but double check just to make sure. If it is submitted separately, there may be a fee.

No additional fee if submitted concurrently or after.... In a after submission you submit a copy of the NOA proving the I-485 was previously submitted

YMMV

Yes - I just found that out, too:-). Thanks

"If you are filing this application concurrently with Form I-485, Application for Permanent Residence, no fee is required to file this form. As of 07/30/07, if you file your Form I-765 separately, you must also submit a copy of your Form I-797C, Notice of Action, as a receipt of evidence for the filing of your I-485."
