Hello everyone,

I received a Request for Initial Evidence (I-485) in the mail yesterday. Is there anybody who had to send tax return documents to USCIS as well?

The letter requests my husband to submit all Federal income tax documentation submitted to the IRS for I-864, Affidavit of Support. What documents exactly does he have to send?

Form 1040 U.S. Individual Income Tax Return

Form 8879 IRS e-file Signature Authorization

Form 6251 Alternative Minimum Tax- Individuals

Form 9325 Acknowledgement and General Information for Taxpayers Who File Return Electronically

Form W-2 Wage and Tax Statement

Are there any other documents we have to send? Or are these documents wrong?

By the way what if we do not have the Form 1099? Do we write a letter to USCIS stating that we do not have it?

We thought about obtaining tax transcripts using Form 4506-T to request tax transcprits from the IRS, but we found out that the transcrips take 2 weeks to be issued.

I called IRS 3 days ago and they said they'd fax or snail mail the tax transcripts. Automated system wasn't working and I got a live person who did offer to fax them. I was in no rush so I took the snail mail route. No need 1099 or W2s with tax transcripts.

Have him call 1-800 829-1040.

Yes, call the IRS on the toll free number and request transcripts, they're free and we got them in the mail in 3 or 4 days (they say 2 weeks but it takes less than that). However, if you filed the 2007 not too long ago, the transcripts might not be processed in the IRS system yet, in which case you have to send to USCIS copies of the entire IRS tax return: all forms (1040 etc) filed and W-2's (if you have W-2, then you won't have 1099, which is for self-employed). If you listed the forms in your opening post, it means that those forms were sent to the IRS, so send a copy to the USCIS (they should have been sent in the first place).

if you filed your taxes online you should be able to print out the last 3 years tax returns. If not, then call them and ask them to mail them to you.

If you call the IRS phone # and ask them, and are by a Fax machine they can fax them to you... BUT they say YOU have to be at the fax machine and tell them that YOU are receiving the fax, and they will ask you a question about the fax that your seeing. I guess there was to verify that your really there at the fax machine..

I guess there was to verify that your really there at the fax machine..

The reason they want assurance that you are the one recieving the fax is that it contains personal info(ie: names, address, SSN's, etc) Not good if that info falls into someone else's hands.

Calling and/or faxing is the best route. I got mine very quickly.

Yes, everybody has to, it's in the directions. You should send the latest year tax return. I think most people opt to send the last 3 years tax return of the sponsor (and any co-sponsors).
